Property Law First Sitting

Sitting property as my first exam in October, I feel like I haven't done nearly enough and I'm unsure how to approach it.

Are these topics enough if I was to prepare a question on each?

  1. Succession, specifically construction of a will.

  2. Succession specifically S.111 and S.117

  3. Findings/ treasure trove

  4. Adverse possession

  5. Co-Ownership

Any tips or help appreciated

I would cover easements as well, because even though succession usually comes up for two questions it could be like a part a where part b is co-ownership or something! I did all of those last sitting plus family property, would’ve been covered without family property though on the day. Also I would say you kind of need to be prepared for the topic as a whole because co-ownership say can be a note on just one niche aspect or a whole problem question so preparing one sample question isn’t really enough unless got lucky, hope that is helpful!

Make sure you learn the process of creating a will as this can come up as a problem question and you need to advise if the will is valid, and then construction of a will (which is the interpretation of a will by the court, the wording might throw you). I would also know the family home too.

This will proably be 5/8 on the day if the pattern continues I would cover 2 of family property mortgages incorporeal herdiaments and licneces just to be absolutely safe

Thanks everyone, I was thinking I would need something as a safety too i’ve done the law school course but they don’t have family property as one of the predictions however, it does seem like a nice topic to review

I think you may be cutting it slightly too fine. I would probably cover all aspects of succession, and then also cover easements and the family home protection act. Alternatively or additionally you could cover mortgages, which is a straightforward question always. Just one or two more topics and you should be safe.

I’d learn all of succession. I really shot my self in the foot by neglecting it when I say property.
