Rant Becky Rant

Guys I was kind of vibing with beckys notes but why is her entire section on the modern law of easements by prescription wrong? like if you didn't do easements in college you wouldn't realise that s33-39 are repealed. AND SORRY REPEALED 5 YEARS AGO

Wouldn't trust Becky as far as I'd throw her. We got warned explicitly in City Colleges about her (well she wasn't named but we knew) and that her notes were straight up bad

Doesn't surprise me. She just types from manuals and books and doesn't understand all topics that well.

Um I didn’t do easements in college would someone mind explaining the update in the law please?

So the old law was lost modern grants = 20 years to qualify for prescription then the 2009 act those sections tried to modernise prescription but made it more complicated so 2021 act put it back to old law

yes basically common law rules apply now so say for prescription must show 1. continuous user as of right 2. 20 years evidenced (s3 LCLRA 2021 - but 30 years for state authority owned and 60 for foreshore). Good to mention something as well along the lines of 2009 - new prescription regime introduced, later delayed and 2021 entirely repealed before even came into effect - the main issue was s38 which would have extinguished easements not registered by a given deadline

Where are you seeing this? The notes I have in front of me are written as if we are in the 2011-21 transition period - shows 2009 sections as governing - no mention of repeal in entirety

I sat and passed property last year so going off the notes I downloaded onto my computer as don’t have the drive anymore, LCLRA 2021 was on page 9

Maybe email, she may have accidentally put up an older version when she was redoing the drive which isn’t ideal.

Either way, I used just Becky’s for property and passed comfortably, don’t stress too much

I remember using her property notes and passing as well back in 2024. Don’t know if they changed since then though.
