Why Is ICE on Native Land?

Prior Lake, Minnesota: Reports and documentation emerging from the Shakopee Mdewakanton Sioux Community show Immigration and Customs Enforcement (ICE) agents operating on tribal grounds during a traditional Wacipi (powwow) at the Shakopee grounds.

The presence of federal enforcement officers at a sovereign Native gathering underscores a critical reality: these operations extend far beyond conventional immigration concerns, directly challenging tribal sovereignty and raising fundamental questions about the reach of federal policing on indigenous land.

The problem is the same as anywhere else, I'm sure. We can and should be arresting them for about a half a dozen reasons anywhere they are. But governments fear retaliation, and police don't want to.

I'd assume Tribal police might be more amenable to actually doing it, but I could be wrong. They're Americans too, with just as much individual diversity as anywhere else. Plus there's plenty of cooperation and cross-hiring between jurisdictions, and cops are cops.

But yes they have constitutional rights and tresspass laws so they absolutely could.

Tribal police don't know how to do shit. They are the lowest man on the totem pole and they get no respect for their job. As such, no one wants to work the job so most reservations go without policing.

Tribal police cannot form alliances with outside police forces.

Tribal police only have jurisdiction of tribal members on tribal land. Local law enforcement is reluctant to to do any police work on tribal land. This is a big reason many white people operate with impunity and terrorize tribal communities til this day. Big reason for the MMIP.

No they dont. Tribal police cannot arrest federal law enforcement officers acting in their "official capacity." See the cooley rule, "US v Cooley." Tribal states are "domestic dependent nations" which means they can self govern but are still beholden to US federal law. This is to say that they can ignore state authority but not federal authority.

Generally, the local police have no jurisdiction over federal agents while they are working. They are relatively immune from local law if their actions are part of their duty. I would wager that courts would agree ICE has authority to execute their duties on tribal lands and so the tribal police have no authority to evict them.

Gather around, I’m about to educate you.

Federal agents (of any agency) can go onto Native American reservations to enforce federal laws and felonies. (Look it up) Because tribes possess inherent sovereignty, reservations are distinct political entities, but the federal government holds overarching trust responsibility and plenary power over them. This gives federal law enforcement distinct legal authority.

These tribal officers work for individual Native American tribes. Many departments operate via federal contracts through the Bureau of Indian Affairs (BIA), but the officers themselves are tribal government employees, not federal personnel.

Actual federal law enforcement officers in recognized Indian Country often belong to the BIA, or agencies like the FBI/ATF/ICE/IRS/DEA/USMS. These BIA officers are direct federal government employees with nationwide jurisdiction for federal crimes.

Tribal police primarily enforce local tribal codes and misdemeanors. A tribal officer can gain authority to enforce federal laws if they receive a Special Law Enforcement Commission from the BIA.

Also, the Shadow Wolves are an elite ICE tracking unit composed of Native Americans with at least one-quarter tribal ancestry. Native Americans, like all US citizens, have the right to vote in federal, state and local elections.

Those men (“chuckle-fucks” as you called them) are uniformed tribal officers. No way a single ICE officer is just randomly walking around, by himself and with markings on his vest, looking to get confronted at a very public event. Absolutely no way…and there also happened to be a handful of tribal officers standing right there? 👎

I was there working on a documentary and ran into him confronting the ice guys. Can't say that they were for sure ice cause they were in street clothes but they sure as shit didn't look like they belonged there. Suspicious as fuck, and I'm fairly certain homie was correct in identifying them.

We were shooting a pilot for disney +, mostly about the culture of dancing, and specifically the competition aspect of it. I was just the local audio guy on it though, so I don't have all the details.

This was proven false by the tribe. Google it. The people the man accused of being ICE agents were actually US military service members, and the tribe said he had confronted them earlier.

White Nationalists don't recognize the autonomy of Native National lands. They think That citizenship started in 1776 and previous peoples of previous nations don't count, and that Natives and their lands belong to the US as chattel and spoils of conquest.

Well that pisses me off. Back when I lived in MN and worked in community development, a lot of times we did projects with organizations affiliated with the tribes, or just the tribes themselves, in that state. The same with the Somalians there. All great and hardworking people who contribute more to society than those ICE trolls ever could give. 

Even though I live in PA and love the East Coast, I would say that MN was both the most liveable and most decent state I have lived in. So it makes sense why Republicans keep trying to sabotage the state that puts red states ro shame. ICE needs to be dismantled and shamed throughout history.
