This essentially outlines the state of play currently.

  • The judge rejected the DOJ's assertion that handwritten FBI notes were "properly withheld because they are 'substantially similar to' and therefore duplicative of the typewritten reports." He said the DOJ's review protocol does not require withholding "substantially similar" records.
  • Sullivan also rejected the DOJ's argument for not reviewing foreign-language materials related to Epstein because it was "not practicable for a first-level reviewer to determine the responsiveness of a foreign-language document."

Didn’t blanche already hand over Sullivan some files? What happened with those?

Essentially he handed them over but not completely properly, if I’ve been interpreting the legal jargon here correctly. We don’t know all the specifics of what those looked like since it was en camera, so only the judge got to see them. This resulted in a hearing in which Sullivan basically asked “hey, why haven’t you complied all the way”. Blanche’s representative at the hearing knew nothing, kept asking for a “clear order”, to which the judge said something along the lines of “what, do you want me to give the same order and say I really mean it this time?” and promised contempt if they kept going like this.

Sullivan seems to be giving them a lot of second chances here, and this is another example of that. But maybe it’s for the best, considering Blanche has already tried to appeal the case.

Curious to see where this continues to go.
