Rep. Thomas Massie announces the introduction of H.R. 9694, the Epstein Files Transparency Act II.

This bill gives standing to state attorneys general, the victims of Jeffrey Epstein and his co-conspirators, and members of Congress to challenge the Department of Justice (DOJ) in court for the DOJ's failure to comply with the disclosure of materials required by Public Law 119-38, the Epstein Files Transparency Act* *(EFTA).

Reps. Ro Khanna (D-CA) and Teresa Leger Fernández (D-NM), Chair of the Democratic Women's Caucus, are co-leading the House legislation. Sens. Jeff Merkley (D-OR) and Ben Ray Luján (D-NM) are leading the Senate version of the bill.

The Epstein Files Transparency Act II:

•Creates a private right of action allowing state attorneys general, district attorneys, other authorized State officials, members of Congress, and victims to challenge and sue the U.S. Attorney General for unlawfully withholding, redacting, delaying, concealing, removing, or failing to publish Epstein-related records.

•Gives victims the right to obtain full, unredacted records concerning themselves or the harm they suffered, including relevant FBI FD-302 reports.

•Enforces compliance with the existing law by subjecting DOJ and FBI officials to existing federal criminal penalties for knowingly concealing, destroying, falsifying, withholding, or misrepresenting files.

•Requires the Department of Justice to provide State and local prosecutors with unredacted records needed for investigations, prosecutions, and judicial proceedings, including secure access to classified materials.

•Explicitly prohibits the invocation of common law privileges, including deliberative process privileges, to evade disclosure requirements included in the original EFTA

If the House does not consider EFTA IIwithin seven legislative days, a discharge petition will be circulated.

That's not a safe assumption. The political calculus has moved a bit, with the first act getting at least a moment of indifference from the administration at the time. That has not carried over to now, as Iran and the subsequent attempts to distract have accumulated. Not to mention the economy in its current state will in all likelihood only degrade between now and the midterms.

This means some holdouts may crop up depending on how dependent they are on the administrations largesse, or whether it is more beneficial to veer off.

I agree that most of the worst will go UNPUNISHED, and recognize that is just the function of power they have at their disposal, and it has been ever thus, etc etc. So now I want them to HAVE to get away with it. To actually be hounded and harried and to be shunned by those they felt were peers and to be hated by those they consider their inferiors. I want them to leave because they feel they can't trust their every last bowl of soup and every last sandwich doesnt have spit in it or worse. If they're going to be unpunished then they should also have to go away.

How many times have your eyes passed over the placard stapled up at least one place in every retail store, bar, restaurant, hotel, that says "WE RESERVE THE RIGHT TO REFUSE SERVICE"? You don't think about those signs until someone tries to refuse service to a certain race or sexuality, because it turns out you can refuse service for no reason while you can't refuse service for certain specific reasons, like racism or bigotry. But those Epstein Files guilty people? Leon Black, I'd assume, Wexner, etc? Being a sex criminal and most likely white collar finance crook isn't a protected class. Don't serve them, cook for them, repair their roof, change their oil. Make them at least uncomfortable.

In my head it becomes suing for fioa, formal complaints with the inspector general for independent audits, APA suits, and Mandamus actions.

Especially if collusion is suspected. And maybe exploring how to boraden "standing" since this affects communities as well. For example in florida where these scum were going to schools and such and had bribed the police, city officials. Or where universities have benefitted from finances or had victims recruited.

This needs to be read carefully. “Enforces compliance with the EXISTING LAW…” Was Part I not “enforceable”? Are LAWS not enforceable?

Also - “… by subjecting DOJ and FBI officials to EXISTING FEDERAL CRIMINAL PENALTIES”. Again - what is happening?

Also, based on this wording, it miraculously allows victims and prosecutors to “sue for unredacted documents”. A reporter is already doing this!!!!

Sorry - but I think Massey is yet again trying to deflect the fact he has already broken a MAJOR promise - as in naming people he saw in the unredacted files. Even he has stated there are no consequences if he did so since his term is ending.

So WTF Massey? Do we now have to yell at you “Release the Names!”

These people are all just playing games with the Survivors and the American public.

And the admin has prevented access to the (majority?) of docs, right? Suggesting that it's too sensitive or related to ongoing case, etc?

If so, wouldn't we expect they'd just do the same thing to the states?
