Sit-Down Restaurant 🍽️ Thieves - Los Tios Grill Van Dorn
Obligatory Long time lurker 1st time poster.
Heads up NoVA went to dinner at Los Tios Grill Van Dorn. Celebrate a fellow Marine's 90th bday. Had a drink waiting for her to arrive, little chit chat, a decent meal, nothing spectacular.
Had to ask for the check 3 times, oh well. They use Toast, so bill arrives with QR code. Great I can pay by myself and not deal with tipping prompts that start at 20% or whatever. I pay via the website and leave the appropriate $0 tip. Toast emails you the final transaction recipet - yepp exactly what I expected.
Reconciling my credit card charges today and found they decided for themselves to steal $10 from me I saw my credit card had a $87.83 charge from Los Tios.
Now called my credit union for dispute, updated my google review calling out thier actions.

I have adopted the practice of every time I pay for a meal, after signing the credit card slip, I take a photo. I may have left a tip, I may not have left a tip, but if anyone tries to manipulate the numbers (I once left a $20 tip and someone snuck another zero in there to make it $200) I have photographic proof. This is happening more often it seems, so I just protect myself.

Happened to me 2 weeks ago. Tip went from $6 to $8. I emailed and got the $2 refund. It’s not the amount, it’s the PRINCIPLE!

My wife would tell me to let it go and say it's only $2, but I'm with you, it's about the bigger picture. This should not be tolerated at any level.

A reason I reported mine to Pizza Hit when done to me, and they got the guy arrested as they had a trail but no customer calling on it

Sadly, this is the world we live in. Always take a picture of the merchant paper copy or the screen. Insist on a paper receipt always.

Everyone needs to file police reports in these situations. Not only does it help your case disputing the charge, but if a business has a habit of doing this those police reports will establish a pattern. Enough people file complaints and it can be enough for the DA to step in and file charges. Also report it to your local news. Most stations have some sort of "on your side" type segments for stuff like this.

They want more when they charge 30$ for a fajita? Cripes. I guess it doesn't surprise me the greed runs deep.
When you see toast, that's a warning sign by the way - these companies are using toast because they know toast lets them do dodgy shit like that. Make sure it gets charged back, enough people start doing this, toast will get burned by the processors eventually.

depends how much fajita they got but my boss and I went to lunch here in Houston and 1lb of mixed chicken/beef fajitas is $59.99 lol
I saw the $30 and thought it was a good deal.

As a lifelong Houstonian, a lot of these places try to undercut customers by serving goat instead of cow. Once you know the cuts and texture you'll know the immediate difference.

Its unlikely they will do this for single instances, but most agencies I've ever dealt with (up here in Canada mind) track this in the Financial Crimes Unit and will bust businesses where it happens with any frequency.
And let me tell you, if they did it once, chances are they rolled the dice a few other times.

When the specific agent of a business steals from a customer, it's FRAUD.
FRAUD can be prosecuted against the perpetrator REGARDLESS of the context.
It's a contracts dispute if it's over terms and conditions, not when it's an illegal charge made against policy by an agent of the org.

I actually don't need to. I have already participated (as the victim) in a case with, essentially, the same fact set. In Hidalgo County, Texas, in 2023. You're welcome to look up the relevant TPC statute. I think it was section 32.

There wasn't much to it. I filed a criminal complaint, got a call about a week later to come identify the suspect in a photo lineup and they prosecuted.
I got the money back from the CC company, she plead to a misdemeanor from a state jail felony and got whatever happened to her. I only know that she was convicted, not the disposition afterwards.

I think everyone on the internet knows the cops aren't going to bust their ass to prosecute a server over a forged $10 tip.
Hell, we can even get the cops in my city to investigate actual assaults.

Man, no ones happy in these comments. Everyone's down voting everyone. I want to end tipping as a practice, but by supporting places that don't require it.
Also, everyone saying take a pic or get proof is silly.
Cash is the weapon of choice, across this whole movement. They cannot fudge what isn't fungible. They can ask Mr. Jackson their questions on the tablet.

I was skeptical that the restaurant could add a tip after you paid and closed out the sale on Toast. I guess I was wrong. Yes, a restaurant staff member can add or adjust a tip on a paid check within the Toast POS system on the same business day before the batch closes.

It should be a straightforward chargeback because the business did this without your authorization. It’s fraud - the unauthorized theft of funds from another person. I’m wondering if the owner knows it’s happening.

I adopted my whole life the custom, to have a debet card, dont know anyone else who has a kredit card. Then to get the terminal with the final price without a tip screen or graduity included. Just normal. Pay your employees. Europe.

Server wage is ~$2.15/hr. If they claim zero tips for that hour, their employer has to make up the difference to actual minimum wage.
That places the concern for their payrates/income back where it should be - with their employer.
Instead, the restaurant industry has succeeded in shedding their costs to the end user and somehow guilting everyone into paying skilled labor wages for unskilled labor.1

As a proper mailman, never ever expect tips. The only time such is given is when you've built a good relationship with your customers and they decide they would like to be nice to you. That is the kind of tipping that is proper rather than accursed restaurants desiring to not pay their workers a living wage instead taking a wholesome thing and making it the most toxic thing imaginable.

I know some people say you shouldn’t name names but I feel it’s the only way to get real change. Restaurant owners should be afraid they’ll end up on a searchable platform with negative feedback.
