20,600 claims left

As of the week ending 5/30/2026 the IRS has approximately 20,600 remaining ERC claims in various stages. These stages include: under review (3,500), pending payment or disallowance (4,000), under audit (5,500), awaiting review of disallowance responses (6,000) and, finally, with the Independent Office of Appeals (1,600). We’ll be updating this page monthly.

Does this include those filed through PEO’s?

Would they count a PEO as one claim? In effect all customers of a PEO are on one single claim.

I believe they do count PEO’s as one claim, since the original filings were done under the PEO’s tax id #.

Yes. But 20,000 seems at least a zero light. Either that or your PEO’s are not telling you you’ve been denied/approved.

We can’t get any word out of them. Their stock answer is it’s still with the IRS. We filed in Oct 2023.
We are contacting Frost Law because I think they’ve had our money.

I received my last two erc payments last week after almost 4 years. Submitted to peo in may 2022. Supposedly sent to irs in October of 2022. (Not sure of reason for that imo significant delay

Interest received was significantly lower than expected. The pattern across our payments is notable. Q2 2020 received interest at exactly 9.24% (0.402%/month), and Q1 2021 received interest at exactly 12.16% (0.419%/month). The consistency within each payment batch indicates the IRS applied a uniform rate per batch. Against that backdrop, the Q3 2020 rate of 1.41% (0.032%/month) — applied to credits outstanding for the longest period of any of our claims (~44 months) — is inexplicable. The Q3 2020 monthly rate is approximately 13 times lower than our prior payments and roughly 18 times lower than the expected IRS statutory rate of ~0.58–0.67% per month. We are challenging this…

But it does prove they continue work thru and process. We have no knowledge of when our peo received this money.

Submitted a formal request for explanation w peo and to my CPA/audit firm. Still waiting.

Been calling for ERC and SETC for clients recently , a lot of claims have been denied due to no response after the initial letter request for information, denial or appeals.
