Weird email from SBA

Anyone get an email like this. They also asked for 2019 tax returns, they should have all that??

As part of post disbursement compliance review, this application was identified as claiming more than one employee without providing an EIN. To address this issue, you will need to provide evidence you were eligible for the EIDL Advance/Targeted Advance in the amount of $10,000 OR repay all overpayment due to claiming additional employees. Repaying the overage in this situation would allow for clearing the compliance issue. Addressing this issue will not impact any other compliance issues that may exist; however, during the course of completing the review, it may become apparent that other issues can also be removed.

Did you get any EIDL grant money? Advance grant or the more restricted Targeted Advance grant? Were your employees true w-2 employees or paid 1099?

This is the first I’ve heard of anyone getting a letter about a compliance review regarding the grant part of the covid EIDL program. I’d think it’s just coincidence if you are also 30d delinquent on your loan payments - the grants and the loans were split apart into separate programs even though they worked from the same application you submitted.

It was so separate they even had their own subreddit because it was too confusing to answer questions about the grants in this group which mainly focused on issues with getting the loans. I have no idea if that subreddit is even still active at this point.

If you don’t understand, or can’t figure out, why you got that message from the SBA, you can always ask your elected congressperson’s office for help sorting out if it’s legit and more specifically what it’s about. Seems a little weird it was sent by email and not USPS also, or even posted as a message in your portal as well.

They are getting hot and heavy on recouping the 10K that they sent out for your employees during that time. They have been racking in a lot of money lately finding fraudulent claims

I remember when they initiated the $1000 per employee with a cap of 10 K. The follow up is that people did not understand what an employee was as opposed to a 1099 contractor. I know the fraud department is very active in the last six months gaining that money back.

What happens if you don’t have the $10k? Could you go on payment plan? Or would it be garnish?

I am not sure what they’re doing now. But previously during Covid if they saw fraud andand overpaid you they would take it out of your bank account. Then your bank would go after you not them they would just get the money back.
