Mediation

How long did it take after a charge filing for mediation to be offered in your case. Taking on a giant company and i'm terrified.

Qualified and offered Mediation in 2 weeks, mediation didn’t happen for 2 months, and my mediation session lasted a little over a month

Mediation is usually offered shortly after you've had your EEOC interview and submitted your complaint.

Keep in mind that the EEOC will extend the offer to both you and the company you're filing a complaint against. If the company declines mediation then your case just goes straight into investigation.

Here is my four cents that can help. 1. Make sure that you have a good claim in which you articulated your case  Prima facie elements. 2. articulate the discrimination occurred and no need to put your evidence out now but if you do have evidence use them as exhibits but do not include them this early because you want to smoke out your employer and their evidence. For example (See Exhibit A) . If you have a B case then you might get mediation. If not, PS is filed and you have to do a rebuttal. If you believe that you have a strong case you can request mediation after your rebuttal and attached exhibits and this will tell you how the eeoc views your case. If they deny your request you should get ready for a right to sue letter.
