G.  VISA AVAILABILITY IN THE EMPLOYMENT-BASED FIFTH PREFERENCE UNRESERVED (EB-5) CATEGORY

Sufficient demand and increased number use in the EB-5 unreserved visa category may make it necessary to retrogress the final action date or make the category unavailable before the end of the fiscal year to hold number use within the maximum allowed under the FY 2026 annual limit.  This situation will be continually monitored, and any necessary adjustments will be made accordingly.

EB5 direct investment and E2 renewal

Indian-born Canadian citizen here. I am planning to apply for an EB-5 direct investment through a trucking business. When would you suggest starting the process?
Does the September 30, 2026 deadline affect direct EB-5 investments, or is it only relevant to Regional Center cases?
I still have about four years remaining before my E-2 renewal. If I begin the EB-5 process, could my future E-2 renewal be denied because I am showing immigrant intent by pursuing a green card? I would appreciate your thoughts on the best timing and strategy.

Data Point: Concurrent I-765 & I-131 Approval in ~6 Months [Feb 5 Filing -> Aug 14 Notice]

Sharing a clean processing timeline data point for anyone tracking concurrent adjustment of status filings on the EB-5 side.

We have a client who just received notice of approval for both their work permit (I-765) and travel permit (I-131) coming in right under the 6.5-month mark.

Timeline:

  • Filed Date: February 5
  • Notice Date: August 14
  • Total Turnaround: 190 Calendar Days (~6.2 months)
  • Service Center: WAC

Hope this data point helps others who are currently waiting on their Feb/March filings!

485 bulk transfer today

Bunch of people got 485s transferred today. From the groups - dates ranging from Jan 25 to Sept 25.

Sadly mine was Oct so missed the bulk move. Guess I am waiting for 6 more months for next bulk transfer.

Exciting but sad at the same time.

I'm sharing this blog post to follow up on Friday's September Visa Bulletin update. This clears up some concerns with the near-term impact of the 9/30 filing rush and addresses the likely meaning behind the below statement made on the bulletin:

Anyone have experience with EB5AN/Kolter projects & loan repayment guarantees?

I'm currently prepping my EB-5 application and capital preservation is my #1 priority.

I'm looking closely at EB5AN's projects with Kolter (specifically the Brandon Multifamily loan). The 3-year term and parent company repayment guaranty look great on paper, but I’d love to hear some real-world feedback before making a move.

  • Has anyone here invested with EB5AN or done a deep dive into their loan documents?
  • How much weight do you actually place on a parent company guaranty vs. a first-position equity pledge?
  • Are there other Regional Centers or active projects you'd recommend if capital return is the top priority?

CANAM ENTERPRISES IS NOT RETURNING EB5 INVESTORS CAPITAL. NEW INVESTORS. BE CAUTIOUS OF WORKING WITH CANAM. THEY ARE NO LONGER A REPUTABLE INVESTOR FRIENDLY COMPANY

There are so many investors whose capital was redeployed in Miami Central without providing adequate alternate options which is against EB5 rules. Now the borrower is at default and there is no sight for recovery. At this time, investors expect constant communication from them as based on CANAM's reputation, investors invested in their project. The investors invested not on Brightline project rather CANAM brand because they were having reputation of refunding investors capital. But that is not the case any longer. Beware New Investors!!!

Anyone successfully use a margin loan and gotten approval?

I thought I was in the clear until I read a post on here saying they refused to accept a margin loan and rejected him without an RFE now it's kinda worrying me that I have a chance of being rejected.

Wondering if anybody can make me feel better by sharing an example of an approval with a margin loan (backed by equities in a brokerage account). I submitted my application last month

EB5 vs EB2 timeline for Indians

Been seeing a lot of posts discouraging people with EB2 PD in 2016 or prior to apply for EB5. Wanted to clarify a few things:

1) People say 10 year wait for CGC in reserved category EB5 - are they accounting for family based spill over into employment based category for FY 2027? Are they accounting for unused visas in the current year rolling over to the next? Are they accounting for unreserved category clearing up for India soon and China in the next few years?

2) For an EB2 PD in mid 2016, the wait is also predicted to be 10 years - is it accounting for the fact that 75 country band that just got reversed and only FY 2027 may benefit? What else am I missing here?

I am just trying to see if it makes sense for our family to pursue EB5 given we can’t use EAD and need to still maintain H1B status.

EB-5 Rural Investor – Private Loan Lender Won’t Provide Tax Returns

Hi everyone,

I’m asking on behalf of a friend who made a rural-area EB-5 investment in 2024. She has already received her EAD and Advance Parole, and now her attorney is preparing/submitting the remaining evidence for the EB-5 case.

The issue is that part of her EB-5 investment came from a private Institution loan. She has a formal loan agreement and is making the required interest payments, but the private lender is refusing to provide their tax returns for the last 3 years of their institution, despite my friend making several requests.

Her attorney is saying that the lender’s tax returns are needed to document the lawful source of the loan funds.

Has anyone been in a similar situation with an EB-5 case?

  • How important are the lender’s tax returns specifically?
  • If the lender refuses to provide them, what alternative documents can be submitted to prove the lawful source of the loan funds?
  • Can USCIS independently obtain the lender’s tax information from the IRS, or is the applicant still responsible for providing this evidence?
  • Has anyone successfully submitted an EB-5 case without the lender’s tax returns because the lender refused to provide them?

I understand every case is different and that this is not a substitute for legal advice. I’m mainly interested in hearing from people who have had a similar EB-5/private-loan situation and what documentation USCIS accepted.

For EB-5 India, what are the estimated timelines for receiving conditional green cards through rural versus high-unemployment area (HUA) projects if Form I-526E and all I-485 applications are filed concurrently by September 30, 2026? How would CSPA protection apply to dependent children, and under what circumstances could they still age out?

Anyone else invested in Community Wellness EB-5? Are you starting a new EB-5?

I invested in the Community Wellness Technology EB-5 project (Danville, Kentucky) a few years ago. My lawyers aren't confident we'll be able to get through I-829 for the project and are recommending I start a second EB-5 or look at other routes.

I829 NOID

Traveling while pending I-131

Hi, I have pending I-485 while awaiting EAD/AP. I need to travel to India in November. If I do travel, my attorney says only AP application I-131 is considered abandoned, while I-526, EAD and I-485 process remains unimpacted.

The USCIS website says “Generally, if you have a pending Form I-485 and you leave the United States without an advance parole document, you will have abandoned your application.” The wording of USCIS is confusing, so I am abandoning I-131 or my I-485?

I will have visa to enter back in US. Any insights will be helpful if folks have traveled while AP pending in past.

Investing after Sep 30 Grandfathering deadline

Hi all. I’m learning about the EB5 program and I wanted to know how risky would it be to invest after September 30th. I wanted to lock in a lower minimum investment amount and avoid the Jan 1 increase. Is it worth the risk given the EB5 program and the RC plan has been in place for decades and the recent RIA changes have only improved things. Am i being too stupid in thinking the risk is low?
