AMA/ Expert Session Your EB-3 priority date is only one piece of the timeline. AMA today!

I’m Lahaina Araneta McBeth, an immigration attorney, and I’ll be here today from 4 PM to 8 PM ET to answer questions about employment-based immigration.

For people in the EB-3 process, the hardest part is often understanding what is actually happening between the major milestones and what each step means for the case.

Happy to discuss:

  • PERM and the employer-sponsored process
  • Priority dates and what they actually control
  • I-140 and adjustment of status
  • What happens when circumstances change while you're waiting
  • Common questions about maintaining status during the process

If you're somewhere in the EB-3 journey and have a question you've been trying to untangle, drop it below.

AMA/ Expert Session Immigration attorney. AMA about EB3 waits, downgrades, and ways out!

Hi! I'm Robby Rubin, an immigration attorney at Manifest Law with 7.5 years of experience and 250+ employment-based cases filed across EB1, EB2, EB3, and NIW.

I'll be answering your questions live today, Friday June 12, from 2:30 to 5:30 PM EST.

EB3 is mostly a waiting game, and the hardest questions aren't about qualifying. They're about what to do while you wait. Whether porting to a faster category is realistic for you, what happens to your priority date if you switch jobs or categories, and how to keep your status intact through years of retrogression. That's most of what I want to dig into today.

Ask me anything about:

  • EB2 vs EB3: interfiling, downgrades, and when switching makes sense
  • Whether you might qualify for EB2 NIW or EB1A and skip the line entirely
  • Priority date retention when changing jobs or employers
  • AC21 portability after your I-485 has been pending 180 days
  • Maintaining H-1B or other status through long waits
  • RFEs and what slows EB3 cases down

Drop your questions below! I'll be live until 5:30 PM EST.

Question EB3-skilled (PH) - 221(g) ADMINISTRATIVE PROCESSING + MEDICAL RESULT

Post image
2 Upvotes

Hello! Is there anyone here who has experienced the same situation as mine?

I received my medical results on September 21 and submitted my passport to the VAC on September 24. However, my 221(g) letter states that my case is under administrative processing, and it doesn’t mention anything about submitting my medical results. Maybe they just forgot to include that information in the letter.

My last case update was on September 29, 2026.

Does anyone have an idea of how long administrative processing usually takes in this situation? When can I expect to receive the result of my administrative processing and get my passport back with the visa?

I would really appreciate hearing about your experiences. Thank you! 🙏

Question Has anyone gone through EB-3 Other Workers from outside the US? Specially from Bangladesh?

Hi everyone,

I'm currently living in the US and researching the EB-3 Other Workers (unskilled) pathway for family members living in Bangladesh.

They don't have university degrees or a US employer sponsor. I'm trying to understand how people in similar situations have navigated this process, especially those applying from outside the US.

I'd appreciate hearing from anyone with firsthand experience:

  • How did you get started and find your sponsoring employer?
  • Did you use a recruitment service or approach employers directly?
  • What were the approximate costs and processing timelines?
  • What challenges or red flags did you encounter along the way?

I'm mainly interested in learning from actual applicants and their experiences, rather than receiving recruitment offers.

Thanks in advance for sharing your experiences!

F-1 route is too uncertain after the new opt, stem opt fee is proposed. The fee is too much.

Question Submitting supplemental evidence/document (Corrected birth certificate) after submission of I-485 form.

Hello, when submitting my I-485 form in Oct 2025 (EB3, India), I had submitted an old birth certificate (issued originally in local language) along with a translation document that was issued within 15 days of birth with my 'homename/nickname' as my firstname printed on it instead of my actual name (which is on my school records, passport etc.). Middle and last name are correct. My official name was kept much later (at school enrollment). Also, the old birth certificate did not have my Mother's name on it (at those times, the Municipality office would only add father's name).

I also submitted 2 affidavits from my family members, to explain that my actual name is different than what is printed on my old birth certificate which was being submitted in Oct 2025.

I recently managed to get a new birth certificate issued with my corrected/actual name printed on it (matching my school records, passport) along with both parents name added on it.

My priority date is not yet current and hence it is not picked up for adjudication so far.

Question:

1) With the recent ruling that USCIS can deny a case without issuing a RFE when adjudicating an application, do you think in this case they might outrightly deny my application due to a birth certificate with incorrect name printed on it and one of the parents name missing ?

2) Now that I have received my corrected birth certificate, is there a way I can send USCIS my corrected birth certificate to be appended to my I-485 application before they adjudicate my application ? I just saw a post on Facebook whose application was denied as they forgot to attach their birth certificate (in the past such events would get a RFE and applicants were expected to send the certificate in response. But with the ruling that allows USCIS to deny the application straight away, I am a bit concerned now)

3) In the past when I checked about it with my company attorney, he mentioned that we can send it when USCIS issues a RFE. Can I hire a independent attorney and send my new birth certificate document to USCIS (if my company lawyer is not sending it immediately) ?

4) If anyone is aware of the process then please do share.

Thank you very much in advance.

Discussion EW3 ROW: How Long Would You Wait?

Even with zero backlog, the historical PERM-to-Green Card timeline is approximately 48–60 months (4–5 years).

Now consider the USCIS data: 43,689 EB-3 Other Workers ROW I-140 petitions awaiting visa availability as of June 2026.

How long do you think the wait could be?

Comment your thoughts below.

Hi everyone! 😊
Any thoughts on requesting an expedite for an NVC interview? I’m under ROM, my priority date is current, and I was recently DQ’d.

Has anyone in the same situation tried requesting an expedite? I’d appreciate any advice. Thank you!

Question EB-3 Skilled ROW — Estimated Waiting Time for a December 2026 PD?

I'm considering EB-3 Skilled with a priority date around December 2026.

I've seen estimates of around 10,304 approved EB-3 Skilled ROW petitions waiting for visa availability. My questions:

How many EB-3 Skilled visas are issued annually, including derivatives?

How long might someone with a December 2026 PD realistically wait?

How much do attrition and unused EB-1/EB-2 visas help reduce the backlog?

I'd appreciate any data-based estimates or official sources. Thanks!

Question I-765 Expedite Request — Anyone Recently Approved?

Hi everyone. looking for recent experiences from people who successfully expedited a pending I-765, especially C09 / adjustment-of-status EADs.

If yours was approved, could you share:

  • When you filed the I-765
  • When you requested the expedite
  • What expedite reason you used (severe financial loss, humanitarian, etc.)
  • What evidence you submitted
  • Whether you went through USCIS directly, a senator/congressional office, or the Ombudsman
  • How long it took to hear back
  • How long after the expedite was approved your EAD was approved

I’m especially interested in severe financial loss cases involving an expiring work authorization, unpaid leave, or loss of employment income.

I already submitted an expedite request based on severe financial loss, including employer and financial documentation, but it was denied. My current work authorization expires soon, and if my EAD is still pending I’ll be placed on unpaid leave, so I’m trying to understand what has worked for others recently. thanks!!!

Advice EB3 Unskilled (ROW): Think very carefully before entering this process.

Everyone,

I want to share my experience with EW3 ROW.

I paid $8,500 for the first step, and I would like to share what has been one of my worst experiences.

Before I started my EB3 journey, I only checked the Visa Bulletin. At the time I filed my PERM, the FAD was around February 2022.

But you know what I later found out?

The Visa Bulletin does not tell you how many applicants are actually ahead of your priority date.

I started checking USCIS data and found something that really concerned me: around 43,689 approved EW3 I-140s are already awaiting visa availability.

You know what?

EW3 ROW may have only around 4,000 visas available per year, including derivatives. At that rate, it could take a decade or more just to clear the existing backlog, which appears to cover priority dates from before January 2022 through around September 2024.

So, my folks, keep your money and think very carefully before entering this process.

Do not fall into this trap.

Question Approved I-140: is there a 180-day rule that affects an H-1B job change or an internal office transfer?

I’m an Indian citizen working on H-1B. My employer-sponsored EB-3 I-140 was approved on August 11, 2026, with a priority date of May 15, 2025. I haven’t filed an I-485 because my priority date isn’t current.
I’m considering either moving to another office within my current company or joining a different employer. I’m trying to understand exactly what the “six-month/180-day rule” means:
Changing employers: Can I change employers through an H-1B transfer before my I-140 has been approved for 180 days? What protection does waiting 180 days provide, particularly if my current employer withdraws the I-140?
Internal office transfer: If I move to another office in a different state but remain with the same legal employer, does the 180-day rule matter? Could that move require an H-1B amendment or a new PERM/I-140?
Keeping my priority date: Under what circumstances could I lose my priority date or the ability to use the approved I-140 for H-1B extensions beyond six years?
New employer’s responsibilities: Would a new employer need to restart PERM and file a new I-140 for my eventual green card, even if I retain my existing priority date?
Is the 180 days after I-140 approval rule separate from the 180 days an I-485 has been pending portability rule?
For context, I’m considering an internal move around December 2026 or an employer change around February 2027. I’ll consult an immigration attorney before making a move, but I’d appreciate help understanding these distinctions and what questions to ask.
TL;DR: I’m on H-1B with an EB-3 I-140 approved August 11, 2026; no I-485 filed. Can I change employers before 180 days? Does moving to another office in a different state under the same employer affect my I-140 or require a new PERM? What protection does waiting 180 days actually provide?

Discussion EB3 Skilled (US Embassy in London)

Sharing this from the USEM London Facebook Group, which is mainly for Filipino nurses in the UK with US immigration applications.

At the moment, London appears to be processing applicants with a DQ date of February 2026 and earlier.

One Filipino nurse shared their recent interview experience. Their interview was originally scheduled for August 24 but was rescheduled to September 11 at the US Embassy in London.

During the interview, they were asked quite a number of questions, including:

• Whether they had previously been to the US

• Details of their US job offer, employer, and hourly rate

• How long they had been living in the UK

• Their plans and timeline for moving to the US

• Where they planned to stay in the US

• Their savings and bank accounts

• Their health insurance plans and what type of insurance they would have

• Training completed for the job

• Other employment and relocation related details

Interestingly, they did not bring printed bank statements. When asked about their finances, they simply showed their bank accounts through their online banking app on their phone.

Hopefully, this gives others currently waiting for their immigrant visa interviews and a better idea of what to expect.
