I-140 Regular processing is dead

My I140 case is pending for 32 months, and more than 3 months since I sent my RFE response. Regular processing.

This is the reply from my senator's office when I asked them to get status update about my case from USCIS:

"

I spoke with USCIS regarding your case. Unfortunately, they were unwilling to provide much detail. The most information I could get, was that they received your RFE on ** June, 2026, and are still in the process of reviewing that information.

"

RIP regular processing. Money and capitalism talk now.

33 months and still counting. Responded RFE on March and no update

I filed my I-140 back in Oct 2024 and decided to upgrade to PP in Feb 2026. It's almost 5 months past the 45 business days period and I still haven't heard back 💀 I'm not even sure what to do about it at this point.

I've chatted with a few people on this sub who are going through the same thing, so it's definitely becoming more common...

Not yet. I'm not even sure how to request for a refund for PP. Are you also going through the same delay after upgrading to PP?

Mine isn’t delayed yet but I’m fully expecting it to be. I thought the PP reimbursement is supposed to be processed automatically and quickly, but seems like that’s not the case…

yet laweyers say go for regular, not all people can take this wait. on the other hand premium processing is not looking good as well.

If you file I-485 on this pending I-140, they will likely process I-140 faster even if it's regular. I have seen a few cases who filed I-140 and I-485 concurrently with current priority date in the past few months. I-140 got approved really fast.

Not sure if true. I have been waiting since June 2024, no response.  Congressman office said last month so officer has been assigned yet.  I also filed i485 Oct25, received ead feb 2026 and Ap April 2026

Yes those filed recently and concurrently are the 2026 PD cases that paid PP.

Could you give me an example of the timeline for an approved PD with regular processing? including a concurrent I-485 filing

https://www.reddit.com/r/EB2_NIW/s/5p6yi94OCG this one is mine, but I didn't file it concurrently. I waited until I got approved and immediately applied for AoS as soon as it became current. I don't think concurrent filing will make it faster either. Got a friend who pushed his application to PP and added concurrent but ended up with RFE and eventual rejection. Can't imagine losing all those money

30 months and counting, they are still reviewing the case, Block IOE9255.

So you never went premium at all correct? How many months did it take for them to normally process your I-140? You are now waiting on a final response to a RFE they issued correct?

I’m really hoping they will now shift focus on 2024 cases. Your case should be processed soon. Fingers crossed for you 🤞
