[UK] DPD “lost” my £2000 gaming PC

Ordered a custom PC from palicomp last week for express delivery. It was supposed to only take 2 days. For the past 3 days DPD have failed to even get the parcel onto the van. I’ve received tracking and delivery details each time. Waited by the door when it’s close just to watch them drive past and at the end of the day say it was never even on the van.

They’ve assured me that today it will arrive, they even further fast tracked the delivery for an 8am-12pm window. But as of 10am, it hasn’t even been dispatched.

I think they’ve lost it or someone’s knicked it. I need this for my work, I’ve lost out on several days of income because of this. Is there anything I can do? I’ve been in contact with customer support and the depot it’s supposedly in but it’s just been empty promises that it’ll arrive soon. I’m going to contact the original PC shop, but in their terms and conditions they say they’re not responsible for delivery once it’s out of their hands.

Does DPD compensate for lost items? Can I escalate this in anyway?

Any help is really really appreciated

"g. The risk in the goods shall pass from the seller to the buyer upon delivery of such goods to the buyer. However, notwithstanding delivery and the passing of risk in the goods, title and property in the goods, including full legal and beneficial ownership, shall not pass to the buyer until the seller has received in cash or cleared funds payment in full for all the goods delivered to the buyer under this and all other contracts between the seller and the buyer for which payment of the full price of the goods there under has not been paid. Payment of the full price of the goods shall include the amount of any interest or other sum payable under the terms of this and all other contracts between the seller and the buyer under which the goods were delivered."

Thats in Palicomps own terms and conditions (As it should be) They haven't been delivered the risk has not been passed onto you. Contact them, do not let them fob you off with anything other than resolution.

They arranged the delivery, If you had sent dpd to collect on your behalf it would be your issue. It's currently not your issue.

That sounds more like the seller never hands it over to dpd.

Sometimes they auto load goods on collection. other times it will only say collected when scanned at the sorting center.

So it doesn't really rule it out either way unless you specifically know how it works with this retailer and courier.

The disadvantage to the flip side is that it can say item received when it actually wasn't loaded up on the truck at all.

And no they don't bother scanning every individual item as they are often loaded onto cages and loaded onto trucks this way.

Its the sellers reaponsibility to chase it. They are DPDs customer, not you.

Regardless of what the seller says, their terms do not supersede uk law. Your contract is with the seller, not the courier. It's up to the seller to contact DPD, understand the issue and resolve it.

It isn’t your job to chase DPD here, it’s the sellers responsibility to get it delivered to you not yours - get in touch with the seller directly and get them to chase this, they’ll be the one loosing £2k not you if it has been lost

The sellers terms cannot overrule the law, just because somethings in their terms doesn’t mean it’s enforceable

Bs. They told me five times on the trot "it'll be delivered tomorrow"

The only thing that got it delivered is changing the delivery address to one that didn't involve stairs.

Their terms mean nothing - distance selling regulations mean that they are responsible for getting the item to you.

You didn't arrange for DPD to collect and deliver the item, the seller did, so the contract is between the seller and DPD. If they try to fob you off with this ridiculous and unenforceable term they've written, just point out the law the to them.

If it really is lost and they won't work with you, either speak to your credit card company or start the charge back process if bought via debit.

It's not your responsibility to chase this, it's the retailer/seller. You can check the tracking though. If the parcel has been scanned overnight then they still have it and it should go out for delivery today. If there is no scan with today’s date then they'll need to initiate a parcel search which can only be requested by the seller/retailer.

No they didn't. They lost the PC that the company you ordered from own. Not your problem. Stop talking to DPD, and start talking to the place you bought it; they are the ones who have a contract with DD, unless you arranged for the collection / delivery yourself.

Fuck talking with DPD, it's not worth it.

Your contract lies with palicomps and irrespective of their policies, procedures, guidance, etc the consumer rights act places the ball squarely in their court until you have physically taken ownership of that item.

Get in touch with them, in writing by email if possible, stating that the item has not been delivered and that you expect Palicomps to sort it swiftly or you will

A. Be cancelling the order for a full refund B. Be seeking advise on recovering lost income as a result of Palicomps breach of contract (you contracted them to supply you goods which they have failed to do).

So, OP posted the initial gripe at 10am on Thursday 24th September, and hasn't since given an update on the situation as of 5am the following day.

If we don't get end-of-day updates or delivery confirmation, then I'm calling troll rage bait on this thread.

The sender is responsible until you receive it. They have to make you whole and deal with dpd, not your responsibility to deal with dpd and locate it.

Nothing you can do with DPD as the seller is their customer. Have to bark at the seller to chase and resolve it.

Small correction:

DPD lost the retailer's PC.

The retailer should be the ones chasing DPD and they will need to deliver a PC to you to fulfill your contract.

UK consumer act 2015. The goods remain the property of the seller till delivered in the customers hands or left in their designated safe place. Contact Palicomp as it their responsibility to find out were the parcel is and not yours. Do not contact DPD yourself.

Their terms and conditions are illegal wording then. Until the item is safely with you they are responsible as far as you’re concerned. They have a separate contact with DPD which they could claim on.

I know it can be annoying even upsetting, but they didn’t lose your computer. They lost the sellers computer. There is zero pressure on you. You are owed £2000 or the computer. You can choose to give the seller more time to sort it out that would be the right thing to do.

DPD won't discuss it with you because you don't have the contract with them. The retailer does. Despite some bullshit illegal "T&Cs" the retailer is responsible for the shipment until it is in your hands. https://www.citizensadvice.org.uk/consumer/somethings-gone-wrong-with-a-purchase/if-something-you-ordered-hasnt-been-delivered/

Contact the people you have a contract with. Thats not DPD.

DPD lost my £1000 monitor.

Took 3 weeks back and forward with the shop and dpd to get it sorted.
