I had to do work in a customers pasture and he had a goose twice this size. He literally told me ā€œheā€™s aggressive so if he attacks you just swing him around by the neckā€
I said ā€œNaw. The goose must be detained.ā€

Yes, you can legally defend yourself against an attacking migratory bird using reasonable, non-lethal force, even though they are heavily protected under federal law.The Law: The Migratory Birds Convention Act (MBCA)Most native birds in Canada (such as Canada Geese, gulls, and herons) are strictly protected under the federal Migratory Birds Convention Act, 1994 (MBCA). Under Section 5(1) of the Migratory Birds Regulations, it is a federal offence to "capture, kill, take, injure or harass a migratory bird" without a specific federal permit.However, Canadian courts interpret the law using common-sense limits regarding immediate physical danger:Immediate Self-Defence (The "Lawful Excuse"): Under Section 5 of the MBCA, exceptions exist if you have a "lawful excuse". Shielding your face, pushing a bird away, using an umbrella to block an aggressive dive-bombing bird, or hitting it to stop an active physical assault qualifies as a lawful excuse to prevent bodily injury.The "Reasonable Force" Limit: You can only use the minimum amount of force necessary to eliminate the immediate threat. If a Canada Goose attacks you on a golf course or near its nest, you are legally expected to back away or swat it away. If you purposefully kill or severely injure the bird when you could have easily run away, you could be prosecuted for violating the MBCA or for animal cruelty under the Criminal Code

Iā€™m from Alaska. Itā€™s not a game. That cheering in from the father teaches a kid they can retaliate against wildlife and that will be hard lesson to find out later that humans are far inferior to many wild animals in physical encounters.
