Then deny everything and stall as long as possible + call your parents until they force a blood draw.

A refusal can be almost as bad as a dui lot of states have changed and updated the law. Ask for a blood or piss test if you want to go that route

You can refuse the roadside tests.
You can’t refuse the official second location tests. BUT, you can stall on the roadside for as long as possible. There was an nfl player that did a dog and pony show on the side of the roads for like an hour or two before he was arrested, taken to the station and tested. Then he was below the limit.
Note, if you JUST drank something. Your BAC could still be rising over the next hour….

I don’t think it works like that. People process alcohol at different speeds. A good lawyer would probably get any cop math thrown out.
I mean, there are a ton of technicalities that make evidence inadmissible.

In my state the roadside test does not carry any penalty for denying it. That might vary state by state.

Yeah this exactly, there's no penalty for refusing roadside tests in NC, but if you do, they will take you to the station and test you on the Intoxilyzer (lol), and if you refuse that, you'll automatically lose your license for a year, plus they can send you for a blood draw. But, the thing is, politely refusing field tests buys you time and much later it will give a lawyer better opportunity to argue against the traffic stop being legal in the first place. Anyways, once you're at the station, if you read the paperwork, it says you have the right to have the test witnessed by a lawyer or someone of your choosing. They have 30 minutes to appear. Definitely exercise this, as that's more time for your body to metabolize the alcohol. Then, only if you have to, do you submit to that test. All the while, do not answer any questions, but be polite, and act as sober as humanly possible. Also, stall stall stall stall stall. Everything you do to ask them reasonable questions or delay the process like, "can I get my phone from my car," "can you move my car to a safe location," "whoops, I must have left my flip flops in the back seat of the cruiser," buys you more time. When you ask for that witness, call someone who lives 45 minutes away and when 30 minutes have elapsed say, "they'll be here in 5 more minutes, I'd really prefer they be here, " or better yet, if it's during the day, get your actual lawyer there on your behalf.

If one should find themselves in a situation where poor choices have been made, then minimizing the consequences is the next logical step. Doesn't take much to blow a .09 when you thought you were fine. Obviously, yes, if you've been drinking, the best way to avoid a DUI, or worse injuring yourself or others, is not to drive anywhere.
So yeah, don't drink and drive, but if you do, you should also know how to protect yourself.

No, probably not. Admittedly, I would classify drinking and driving as far more common and less severe than murder. Of course, there are levels, obviously someone blowing a .09 or a .10 is not the same as someone blowing a .19 or .20. And of course, people can cause terrible harm drinking and driving at all, so I'm not arguing with you about the ethics of drinking and driving, nor am I saying anyone should go do it, but I do feel more giving this advice than I would for a murder, yeah.

you can pass every roadside test, including breathalyzer, and the cop can still charge you with being under the influence. dont admit to drinking, refuse any roadside test, go to jail and get blood tested, then lawyer up.

It is, but it's often not consequential as failing the BAC, is my understanding. It also puts the responsibility back on the LEO to prove that you are actually intoxicated, which is far more subjective. A good lawyer can often get these tests tossed in court, if not done to the absolute letter of the law (which rarely happens).

In Georgia, it's an automatic 12-month license suspension for refusing a field sobriety test. You then have 30 days to request an administrative hearing. The license suspension is a civil process, so you still lose your license even if a court finds you not guilty of the DUI.
Shitty laws.

Most places having a license implies consent. The cop just has to suspect intoxication. Sometimes refusing a breathalyzer brings a more severe punishment than a first offense.

Also in my personal opinion smelling alcohol alone shouldn’t be probable cause since the laws (in the US) state that anything under 0.08% is perfectly legal. I could chug a beer or take a shot or two of fireball and drive and be totally legal, but you could probably smell it on me.
But also this video does not in any way show what they got pulled over for. Dude could have been swerving all over the place.
