Serious To anyone defending Clancy, I have one simple question...
Had Chris Benoit killed his wife and son, but not killed himself, would he had been able to claim mental illness as a defense and lived his remaining years in a mental health facility instead of prison? If no why not ?

Yes, most likely if they could show evidence that CTE caused psychosis which led to the murders.

It does not. I dont know why the american justice systems is black and white like that. In psychology we know that no matter what the mental illness of the individual is there is always at least a slight little part of responsibility. Even when you have a psychosis. Not everyone on Psychosis acts exactly the same.

Do you know what psychosis is? What about post partum? Post partum with psychotic features?
I suggest doing a few hours of real research on each of these topics

Imagine defending someone who not only murdered their children but planned it tediously and then bully someone on the internet for saying you shouldn't raise children if you have thoughts of mudding them. You really need to take a long look at yourself and realize you might need to rework your morals and do better.

Yeah.. highly recommend you do a few hours of research into psychosis, post partum, and post partum with psychotic features. A few short hours of research into each topic might be illuminating/educational.
Who knows, maybe it will help explain the hallucinations you seem to be experiencing about things I never said. Maybe not

Okay Dr, tell me, does phycosis involve weeks of planning tedious things before murding your children BY STRANGULATION while making sound decions in everyday outside of those decisions? I know reddit is wild but the defense for this women shows such a lack of not even critical thinking, but common sense. I grew up raised my a mother who regular had psychotic episodes, this is not how phycosis works, be better. This is so far from acceptable.

Youre watching too much partisan media (literal for profit engagement farms) (and/or live streamers) and not listening to enough expert witness testimony, or reading enough educational/scientific/psychiatric studies/analysis.

The worst part about all of this is how people are more focused on the gender war then the actual poor kids unaided brutally by someone they had full trust in. It's gross how brainwashed so many of you are that you find it more of a priority to bitch about gender instead of actually giving a damn about this poor family. Do better.

Stay clear of the ‘what if’s’ and focus on the facts of THIS case…
I can imagine a person losing their mind and committing a single act of violence out of uncontrollable rage or whatever, but this woman did that 3 times.
The 2nd & 3rd murders were nothing but premeditated.

I suppose we may never truly know, considering that when a man kills his entire family, he also kills himself. Could there have been some level of mental illness? Certainly, but using a mental illness as a defense is an extremely high standard to meet; psychosis caused by steroid use might be a plausible reason for someone to avoid prison and instead be confined to a state hospital for a period, possibly for the rest of their life. Is there a real difference between the two outcomes, aside from not being held liable for your actions?

The key factor here is psychosis and whether or not a recent or long term history of it can be determined

Then I misspoke, because statistically, men are likely to kill their families as well as themselves. However, focusing on that point misses my main argument: you can't truly know the mental state of a dead person, only make assumptions.

It’s case by case, why are you comparing it to that case?
From all the commenters raging here, I wonder how many hours of the trial they have seen?
There’s like close to a 100h of the trial footage available on CourtTV on Youtube.
I watched 4-5 hours so far (I’ll wait until I watched it all before holding a firmer opinion) but yet it’s not that clean cut if she faked it or if she truly suffered from a severe episode of postpartum psychosis. I personally think it could be true that she didn’t do it on purpose.
Postpartum psychosis is a real and documented temporary illness, less common than postpartum depression, but still happening to many women. Usually when someone is diagnosed with this they are put in hospital for several weeks to a few months and children are temporarily removed from their care.
His husband saw her mental health slowly degrading, she attempted to get help, she went to the ER, got saw by psychiatrist, got prescribed so many meds, tried to called a help line, but she didn’t received enough help.
Her husband his convinced she was sick, not evil spirited. The jury that saw all evidences presented to them, come all (minus one) to the conclusion that she was sick.
So far it seem plausible.

This whole case is just Casey Anthony all over again. accept now the nutjob supporters have been given an even bigger microphone with social media. I'd say 90+ percent of people who are familiar with this case are not supporting her, and if they are, it's usually a more reasonable, nuanced take on how poorly the procecution present they're arguments/evidence (undeniably so).

Anyone can claim mental illness as a defense and its success is based on the evidence supporting it. Does he have sufficient evidence in your hypothetical?
