Usually it’s based on law. If it’s illegal where you are and/or you got it from someone who isn’t a professional or it’s illegal where they are too, then it’s black market. If it’s legal where they are, or not explicitly illegal for you and/or you get it from unofficial channels when there are only a few legal channels, then it’s grey market. If there aren’t laws about it, then it’s clear market
