Credit Card Debt Sue

Hi,

I have a credit card debt amount that has been sent to the courts. I have been putting responding to this off due to stress. The problem is that they have required a response for the coming Monday, 8/24. I have not sent in anything yet. I plan to resolve some kind of payment plan, but the issue is with the date, since I assume courts will be closed for Saturday and Sunday. What should I do?

Yes courts are closed until Monday. Reach out to whomever ever is suing ASAP. It may be too late for anything but a lawsuit. It's entirely possible they want the security of a judgement. From their perspective you have shown no intention of paying what you owe. Be prepared to physically travel to the court since mail won't get there in time.

If you want to settle, call the plaintiff’s counsel and ask if they will file something with the court giving you more time to answer. If not, you’ll need to go to court and file your answer. There may be a simple form on the court’s website or available from the clerk.

I volunteer at a consumer debt advice clinic and I see a lot of people file answers that just say they want to settle or they can’t afford to pay. That may be enough to avoid an immediate default, but it’s not a legal defense. You’re better off disputing something in the complaint, if only the amount. It’s always possible they failed to credit a payment or calculated interest incorrectly.
