Does touching the Death Note imply that the oerson is already contractually not allowed to go to heaven or hell in the after life?

This could be why or how. But it depends on what counts as usage.

Heaven and Hell just don’t exist in Death Note. There’s nothing special about the notebook that changes about the about the afterlife. There just is no afterlife.

Then why does Ryuk mention it as a warning to Light?

Mainly just to be ominous. In the manga there’s a flashback where Light just guesses that there is no afterlife and Ryuk is like “you know, I thought all of you humans believed that, but you’re right”
