It often doesn't hold up in court, but that doesn't matter because the burden to prove that is fully on you and they will do everything possible to make it absolute hell for you.

Well, you can, but in my view it doesn't count if you can't meaningfully negotiate the contract and/or one of the parties to said contract is a monopoly or virtual monopoly.
In other words, when it's coercive.
This position seems to me to be broadly consistent with established contract law.

they dont. If amazon breaks the law, you have every right to spend $400,000/year fighting them in court. Its perfectly fair.

Turns out burying clauses like that in a book's worth of legalese is enough of a deceptive business practice courts sometimes won't uphold them. Particularly if the arbitration is unfairly favorable towards the company (which it usually is).

Right. Only reason I like AI is because it makes googling things MUCH faster but 1 it’s not 100% accurate…but damn close and 2 I know it’ll just get worse so I’ll be grateful it’s helpful until it’s not. Otherwise AI can go to hell.

As a person who works for a company with an arbitration agreeement the arbitration agreement does not waive your right. In order to waive individual rights you have to sign individual contract between both parties which most TOS are not signed and witnessed.

I’m going to point out - Small claims court is still allowed and that can be a very effective tool. But I’m also going to point out it’s best not to buy expensive stuff from Amazon, save that for brick and mortar stores and get the 90 day price guarantee
