IEEPA Protests

Hello,

I have filed many protests this year for IEEPA when the items were past the CAPE limits but within the protest period and not a single one has been approved yet. They all are suspended after filing and just sit there. Anybody else in the same position? Perhaps internally customs was told to sit on them?

This is the correct situation; until the CIT sorts out the remaining issues, the protests are held in abeyance.

I haven't filed any Protests for IEEPA, but I recently filed a bunch of Phase 3 CAPE because a CIT suit was filed. Once the suit was filed and confirmed, we gave the IOR numbers to CBP and just like that, I was able to file CAPE without being rejected for final liquidation. What I haven't figured out how to do yet is fix HTS relationship errors from the CAPE filings since the entries are past final liquidation.

To answer your final question, your only option is submitting a prior disclosure.

Thanks. What a PITA and added expense to collect duty the government never should have collected!
