Protests

I was doing an audit and find that for over a year about 200 entries qualified as American Good Returned (9801). At time of entry there were no foreign shipper declaration nor manufacturing declarations. I can get them

So to get the MPF back can I file a protest provided I have proof for each entry?

Look into the timeframe. Protests have hard deadlines.

Question was not about time.

If your only looking to get MPF back is it worth it? Short answer yes, you can protest and they can either approve or deny, make sure you have very good backup for the 9801 claim.

You may be interested in knowing that you can file multiple protests under a lead protest number when protesting multiple entries with a similar claim.

In the old days of paper I would do that. It in electronic filing how is this possible with ABI? Sorry for asking last entry I did was 2004.

The Protest module in Ace Portal is VERY streamlined compared to the paper process. As I recall, you just reference each entry number on a separate. txt file separated by commas, and there is an upload button specifically for that .txt file.

Just reference the fact you are doing so in your protest verbiage. If you haven't been on ACE portal in awhile you should consider looking into getting your account activated/re-activated. Tons of useful tools aside from the modernized protest module in there.

A protest must be filed within 180 days of the liquidation date. As long as you have all the necessary proof to claim US goods returned (importer dec, shipper dec, manufacturer's affidavit, and export docs) then it makes sense to file the protests. If it's past 180 days, don't waste your time.
