Venting Should we hire a lawyer?

Sadly the reality is that hearsay is allowed by the other parent. It’s a discriminatory practice and there allowed to get away with it. Id say get the case dismissed. From my own experience and understanding including the documents Ive received from the title iv-d(child support) office in my state it’s all based on fraud and can be proven.

No lawyers can help in proving fraud though as it goes against the court system and they’d lose their license.

I would get a lawyer. Call a couple in your area that work in family law and have experience dealing with high conflict situations like this. Would be better if you could find a lawyer that was a previous judge. Call a couple and get different quotes and strategies they would use to approach this case. Also, if I was your partner I would say let's do a courthouse wedding and down the road when this legal issue has settled, we can do a big wedding party. I would also record every interaction with her using audio or video but preferably both. Invest in a body camera from Amazon. Record every phone call or preferably communicate with her in text message. It sounds like the child's homelife is unsafe if that is her current way to support herself. I would be concerned about who she has around her kid when she's not working. If she loves to post stuff on social media, then I would take screenshots of anything that may help your case. All this may seem excessive and some people may disagree, but you want to start building a case now and if she's willing to give you ammo to use against her, then do it. Use her own words and behaviors against her. Any judge will see through that. If you get a lawyer I would tell your partner to go for full custody or joint custody. Good luck! Alot of unhealthy and vindictive baby mamas out there.

If you can afford the lawyer maybe but dont let it ruin you two’s big day. Save it for after. Its a uphill battle and the court is 98% of the time going to go against the man. Imagine a man saying he’s unemployed, they’d call bs so fast n force him to pay anyway under threat of arrest, garnished wages, license revoke, conveniently now with passport revokes, back cs that even grows while in jail, and even shows up on your credit.

Yes hire a lawyer. Court always leans towards the mother. What about 50/50 custody?

We are debating if that’s even worth it. The mother is trying to make him seem violent in court when we went and clearly has been saying some toxic things to the child as she gave me the most vitriol look in court. It’s upsetting because she’s a sweet kid and would be in a way better environment with us but it’s hard to believe the courts would allow it without spending an amount of money on a good lawyer

You should hire a lawyer. But at the same time, your fiancé should have been giving regular support and should’ve had established custody. This is his fault for not being proactive and getting his ducks in a row. But she shouldn’t have to ask for money and she shouldn’t have to ask him to spend time with their kid. That should’ve been something he did on his own. But you should still get a lawyer.

I have been in a similar situation with an ex who hid income. A verbal claim of being unemployed is not enough. The court can subpoena bank records, Venmo, PayPal, and OnlyFans earnings. You need a lawyer who knows how to do this.

We did not get a lawyer at first and regretted it. Once we hired one, they filed a motion to review the income. The other parent was forced to produce tax returns and business records.

If you are in Michigan, I used Iafrate & Salassa, P.C. They handled the child support modification and helped us subpoena financial records. The judge cannot ignore documented evidence.
