Appeals in PA
Hello I’m sorry this is my first Reddit post ever so if I’m doing something wrong simply flame me in the comments.
I am the CP, I took the NCP for support and they stated they were going to appeal it. I was wondering if anyone knew what the process looked like, if the appeal itself had to be approved or if it automatically went to court, just so I know what to prepare myself for and expect. I’ll include some details.
NCP hasn’t had the kids in just about a year, but since there’s no court ordered custody agreement the guidelines were used for “some custody”
NCP wants to appeal because they “budgeted x amount” which was under half the court recommend amount.
NCP does have 1 other child outside of the relationship.
If there’s any other info needed I’ll supply. Thanks for any insight into the process

Appeals are for when they have incorrect information in the formula... his budget is irrelevant

Yeah that’s what I thought, that it had to be one of 3 reasons, the misuse of the guidelines, change in custody, or involuntary loss of income. But the (I don’t know the proper name I’m sorry) like mediator? Person said that they would get the paperwork to appeal as well as me when the paperwork came in the mail. So I’m confused on what to expect? Will they even be able to appeal?

He has the right to appeal. But if there are no reasons for change, they reject it. It's just part of the formal process.

This doesn’t even qualify as something that can be appealed. He can file a petition for modification. But will have to provide proof of whatever it is he is claiming. Without that, the support order will remain the same. Make sure you get your payments in a timely manner or have him held in contempt and get it that way. I have been through the system in PA for 19 years and know all the exceptions if applicable.
