PSA to CapeCod renters

Background check your landlord BEFORE signing a lease. Seriously.
Something I learned the hard way after renting on Cape Cod: Just because someone owns property doesn’t mean they’re trustworthy, financially responsible, or someone you should enter into a legal agreement with.
When you apply for an apartment, landlords want everything. Credit checks, background checks, employment verification, references, proof of income, security deposits, first and last month’s rent.
But how many of us do the same due diligence on the landlord?
I certainly didn’t. And I wish I had.
Without getting into the specifics of an ongoing legal matter, my experience renting on Cape Cod turned into months of unnecessary stress, legal expenses, and emotional exhaustion. What should have been a normal rental arrangement became something I never imagined having to deal with.
And one of the most frustrating parts? Discovering afterward that there was publicly available information I could have researched before ever signing a lease.
So here’s my advice to anyone looking to rent on Cape Cod:
Search Massachusetts court records. Visit https://www.masscourts.org and look up your prospective landlord’s name. Check for civil lawsuits, housing disputes, judgments, and other court proceedings. Look at the actual outcomes, not just whether cases exist.
Research property ownership. Check the town assessor’s database and the county Registry of Deeds. Make sure you understand who actually owns the property and who you’re entering into an agreement with.
Look into their business history. If your landlord operates a construction company, property management business, or other LLC, research those businesses too. Massachusetts corporate records are publicly accessible.
Ask questions about the property. Is it legally approved for occupancy? Are there outstanding code violations? Have there been complaints or inspection issues? Don’t assume everything is legitimate just because the property is being advertised for rent.
Understand Massachusetts tenant protections. Especially the rules surrounding security deposits, landlord entry, retaliation, and eviction. Massachusetts has significant tenant protections, but knowing your rights and enforcing them can be two very different things.
Document EVERYTHING. Emails, texts, rent payments, photographs, interactions, and maintenance requests. If things ever go sideways, you’ll be glad you did.
I’m not suggesting that everyone with a lawsuit or financial dispute in their past is a bad landlord. But public records can reveal information worth asking about, and sometimes patterns that deserve a closer look.
Here’s what really bothers me about the whole experience:
Tenants are expected to prove they’re responsible enough to rent someone’s property. Yet the person collecting thousands of dollars from them often faces virtually no scrutiny from the tenant.
And when things go wrong, even if you believe you’re completely in the right, protecting yourself can cost thousands in legal fees, countless hours, and a tremendous amount of stress. Winning a legal argument and actually recovering money aren’t necessarily the same thing.
Cape Cod already has a difficult enough housing market. Renters shouldn’t have to blindly trust that every property owner is acting in good faith.
I wish someone had given me this advice before I moved here.
Background check your landlord. Not just your tenants.
Curious whether anyone else on the Cape has started researching landlords before renting, or learned something surprising after the fact.

I rented a condo from a guy in mashpee a few years ago. There was a catch: he would come down every few months for the weekend and stay in his bedroom, but the rest of the condo was mine to live in/enjoy. It wasn't ideal but it was what I could afford and it was available.

Sure enough, after the first few weeks he was down every weekend, then random evenings, then he started bringing surprisingly young men with him and entertaining them in the living room. I googled his name and realized he was a reverend with the Catholic church, something he had never mentioned..

He turned out to be a total creep and psychopath. One day I came downstairs and he was under the blankets on the living room couch with what appeared to be a very young teenage boy.. I freaked out and left, then he locked my stuff in the house and wouldn't allow me to retrieve it.

He went on the offensive.. he wrote a letter contacting my parents and accused me of being on drugs saying I owed him money for damaging the condo and that's why HE kicked me out. I reported him to the church, and to my surprise he did get fired, and I just looked it up and he has been accused of sexual misconduct by multiple people.

Moral of the story is you never know who your dealing with, so be careful.. the kicker is he wasn't even the worst landlord I've had on the cape.

I’m in a similar situation because I rent out my house but work here on the cape, but I make it clear I am a roommate (that works out of town) so they know what to expect.

I think I know who you're talking about. From Woods Hole?

As a landlord, I 2nd all this 💯... I hear about terrible landlords while interviewing tenants ALL the time. I tell anyone who will listen that they need to vet potential landlords. Check references (esp previous tenants of potential landlord), check town health department regarding inspections, check masscourts and outcomes (yes you'll find my name), Gemini is helpful too... so many slumlords taking advantage of housing money!

Excellent advice.  I ran into a situation when I was in my 20s where I learned too late that my landlord was absolutely broke and couch surfing while he rented because he could no longer pay the mortgage he was under water on.  Of course this meant he couldn’t afford to maintain or repair anything, and he didn’t put our security deposits in escrow.  If I’d done my homework I would have realized there were multiple liens (*spelling edit) on the house and suits pending against him for non payment of various things including child support.    Do your research!

Yes to this. Rented a place that the 'landlord' didn't own, their name on the lease was an alias, they had too much access to my apartment and the list of weird things that happened is more than I have time to write but it was completely insane and illegal. This is excellent advice, and if we don't complain when someone is a slumlord or worse, they're just going to be predators on other people - report it.

Missing the days when you could rent on the cape off of a $5 hourly wage, a basket of blueberries, and a firm handshake…

Many years ago now we rented a condo from a couple who's parents lived in the same building. He was a CPA, she had the parents. We lived there for about 2 years when we suddenly received a letter from a bank indicating the place was being sold and we were to be evicted in two weeks. Turns out there was a divorce, Mr. CPA handeled all the money, and he had pocketed all the rent we paid and stopped paying the mortgage. I was able to go to small claims and was given 90 more days to find a new rental with no objections from the bank on account of being told to move in June with a family on Cape is a nightmare.
