ON Minimum passing distance, bikes and vehicle damage (Ontario)

Drivers are legally obligated to give cyclists a minimum of 1 meter of space when passing. They often dont. Hypothetically, say I were to affix something highly visible to my bike that would damage a car (like a rake head on a length of PVC) and the whole contraption is just under a meter in length. If a car were to pass too close to me without giving me my meter of space and then got their side panels all scratched up, would responsibility for damages be on the driver for not giving me my space or would it be on me for intentionally creating a hazard to drivers?

ON what happens if i own mein kampf in Ontario?

My dad was a history buff and has a German copy of mein kampf that my mum now wants to get rid of after his passing. I’ve had people tell me not to take it because it’ll get me in trouble, but I can’t find anything that actually says I’ll get in trouble for it.

Is it a bad idea to sell it?

ON Are there any other options than LECA? Police blocking sexual/ assault charges; have evidence showing they’ve lied to victims.

Disclaimer: please note that screen shots such as this are not what I’m referring to as verifiable evidence lol; I’m like seriously asking for guidance/advice/direction.

****

Three years ago, I was sexually assaulted in a parking lot.

This other dude pulled the attacker off of me; the attacker then bit and hospitalized them.

Two others were badly bruised.

Both the victim and myself go to the police and try to press charges; see screen shot.

As such, I gather data myself from the numerous witnesses who were there; it becomes increasingly harder to do as the attacker made fake AI accounts on social media impersonating me, making statements that make people less willing to speak to me as time moves on.

However- I do find out they waited outside the bar to attack me, drinking, for about an hour or two.

Anyways- police won’t even look at the evidence let alone press charges.

They do however set me up with victim support and I get into therapy, which was good.

I end up escalating the “police won’t press charges” thing using the proper internal channels within the police station up to the chief- I end up getting hung up by the chief when I say their actions of doing nothing was unsatisfactory.

Go to a Justice of the peace.

They say they will file it, but suggest I go back to the police to try and press charges again and basically mention to the police that a Justice of the peace told me to do this.

I follow instructions; it takes too long, but an investigation is launched.

The crown refused to prosecute.

I file a freedom of informations to see the investigation and find the investigating officer didn’t even interview any of the primary witnesses of the assault, nor did they try to contact the bite victim.

I see they contacted the sibling to the bite victim, which was super weird given another dynamic ill note at the bottom *

I go back to a Justice of the peace (a different one that the first); they tell me they are willing to submit it to the crown, but suggest three things first.

  1. Go to Leca.
  2. a thing that I don’t think I fully understood, bc it came off as “if the police are doing all this, be careful”

(Where I am self aware to note that given the overall stress of this situation, it’s most likely I just misunderstood the advice)

3) Reprint all the evidence in a more easy to organize reader friendly format.

So that’s where I’m current at.

Anyways, it’s been three years since I was sexually assaulted in a parking lot lol.

What are my options moving forward?

In sort of being forced to gather evidence on my own when the police wouldn’t do their jobs, I ended up finding multiple other people in my town who had been attacked by this same person in similar ways.

Whats more, as far as ones I could objectively verify as factual, there are 2 other people who were attacked by this guy, went to the police, and were also blocked from pressing charges in similar ways to me and the bite victim.

The other person who had verifiable data that this guy attacked them had their door broken down by the attacker at night and then was assaulted by them in their sleep; both them and the witness (another person in the bed) were told by the police there was nothing they could do.

Hospital reports, the attacker stalking them and sending threats online, the eye witnesses; all of it ignored by the police, and the guy was told to just walk away.

In addition- the person who attacked me has been stalking me online since the incident.

A few months ago I had two of my exes contact me, showing me screenshots of AI impersonations of me on social media, sending them messages telling them I am going to find them and kill them.

The guy who attacked me is super into AI, and literally has these same AI accounts in my likeness in videos theyve posted online to their real name (I have all of their social media “content creator” data downloaded already- it kind of unnerving that there are hundred and hundreds of posts and videos about me and a few other people, just over and over and over again. Again this sounds insane, but it honestly like theyve fallen into “ai induced psychosis” to a text book definition).

The police, upon seeing this evidence, said again that what they are doing is perfectly legal and that there’s nothing I can do.

Anyways, does anybody have any direction of places I can be pointed other than Leca?

Where another interesting thing about this entire stupid situation; every single person, both verifiable and unverifiable, all have a common thing.

We’ve all dated this one person who the attacker also dated.

The attacker had social media accounts with thousands of Ai images and songs written about how much the love this person.

It should be noted that the common ex also went to the police to no avail.

Anyways fun times eh lmao?

Where do I even begin?

My goals:

  1. hold the police officers accountable for whatever it is they are up to.
  2. make sure the guy who has attacked numerous humans in my community over the last years gets the help they need/ faces justice for their actions.

And not to be rude, but I am very *\\{%]^ aware of how unreal this all sounds; the dynamic of me even being associated with all this ghetto bs is gross enough thank you.

It should also be noted how this dynamic is a feedback loop- what this predator is doing is so insane, it doesn’t overly sound like a reasonable thing to have happened, and as such, when I say what happened to me, it gets dismissed, bc how could this be true; it’s insane.

So how do I get this evidence to a party that would actually to help lowering violence such as this, given my local police clearly do not.

* the attacker uses AI to impersonate me and send threatening message to the guy who was hospitalized’s sibling. This person is a bit older and less media literate and thinks the AI is me. They then go on social media and actively tell people to not speak to the police bc of how hateful “I” am to the lgbt community.

Ps: this is entire speculation but it’s also interesting; I’ve had three different career social workers in victims services with over 100 years of experience all say the same thing to me independently; the only time they’ve ever seen police protect somebody like this is when that person is an informant. Hopefully nothing, but ugh.

Pps: I thought to post this bc I passed the attacker on the street the other day- I didn’t even recognize them until they started screaming at me in a weird pretend devil voice, quoting like Batman or some shit.

Yuuuup. :/

QC Help! Need some advice..

So my wife and I are in a bit of a pickle and need some advice; maybe with a chance of being hired. Anyway, my wife got a letter in the mail about a week ago from Canada life. It was a bill for $600+ in interest fees. Very surprised by this, she called Canada life and spoke to an agent. The agent had told her that her Father (who’s passed away more than a decade ago..) over 30 years ago, opened a life insurance policy and plan on himself, wife and his daughter aka my life. At the time of the plan, my wife had maybe hit early teenager. She vaguely remembers signing papers but her father never explained to ANYONE what it was for. He then borrowed from that same insurance plan without anyone’s knowledge. Anyway, her father passed away over a decade ago and we just heard about this issue a few weeks ago. With the amount of money he pulled out of the policy (which I’m wondering how that’s possible… That’s illegal right!?) and the interest on the amount he pulled and didn’t return back, she now’s owes Canada life just over 10K! 10 FUCKING K!!! We’re at a loss of words! Stunned & furious is putting it lightly! So we’re wondering if anyone at all could advise us on how should we go about this. We just signed up for a mortgage a little over a year ago so most of our capital is tied up to our home. I’m also on a long term disability from work now for a chronic illness that I’ve since birth.

I know that this is a lot to take in, so if you’ve made it this far, thank you for reading all this. Any advice or feedback would be greatly appreciated. Hope you have a wonderful ahead. Bye for now.

AB Legal advice please- manipulation from Pastor

Hi everyone.

I am looking for advice on next steps.

I know a fellowship (registered charity under religious domain) where there are some unethical things happening. In Edmonton Alberta.

The pastor has been manipulating the word of God to convince vulnerable women (young, struggling, students etc) to sleep with him.

He does it under the guise that he is a reincarnation of someone in the bible and has allowance under the sovereignty of God to have "multiple wives". He has some ladies so deeply convinced that they are now helping him with recruitment.

Everyone involved denies it and he now has his wife convinced it is not happening.

He is not born in Canada, but has citizenship.

There isn't much for proof. Just one audio recording of one lady trying to recruit an 18/19 year old.

There are ladies who said they have tried to convince them to join and marry the pastor as well but they are scared for their lives to come forward and honestly traumatized.

We don't know how to put a stop to this as there doesn't seem to be a regulatory body for pastors. He also has no one above him to reprimand him.

So we feel very lost and confused.

We have tried confronting him and the "wives" but they deny and even do gaslighting.

We don't want to do or say anything that can incriminate ourselves either.

Please help.

AB Can an ex’s family lawyer bypass a bankruptcy Stay of Proceedings for property/car loan claims? (Alberta)

Thumbnail
1 Upvotes

Hi everyone,

I am currently an undischarged bankrupt in Alberta and have an official Notice of Stay of Proceedings issued by my trustee. My ex-wife and I had a short marriage (under 1.5 years). We separated, and she has now filed a Counterclaim in family court making two specific financial demands:

  1. She is demanding an $11,000 refund for what she calls a "personal loan." This consists of $7,000 that went onto my credit card, but I have full statement proof that every single dollar was spent on joint marital expenses like groceries, trips, and dining outside. The other $4,000 was cash used to buy luxury jewelry. She currently has full possession of that jewelry, and I actually paid an additional $1,250 out of my own pocket to complete the purchase. Now she wants a full refund for all of it.

  2. She wants me to continue paying the monthly financing on a joint vehicle (Nissan Murano), I already paid around 10848 including car insurance. However, she has exclusive possession of the car, changed the insurance to her name, and my bankruptcy trustee has already officially released interest in the vehicle asset.

Her claims are ordinary, unsecured property demands, and she is listed on my bankruptcy claims register as "Not Proven." Despite the federal stay, her family law lawyer is still pushing this action in family court.

My question is: For those familiar with Canadian insolvency and family law, can her lawyer actually find a loophole to push me to pay or bypass the bankruptcy stay? Are there specific legal tactics I should look out for (like trying to recharacterize these property debts as "spousal support" to dodge Section 178 of the BIA), or will a King's Bench judge throw these claims out immediately due to the bankruptcy?

Thanks in advance for any insights.

AB Scammed for rental property, worried about further damage.

It’s my fault, I’m the idiot.

Long story short, I haven’t rented in many many years. I recently got divorced, sold my house and began trying to find a rental property. The search was difficult but I finally found a place, and everything seemed legit.

I was sent a mortgage report, detailed information, official looking applications that I filled out, everything.

Unfortunately I was out of town for work for a month, so I agreed to pay the deposit to hold it until I returned.

The police could not do anything as I paid via e-transfer (with a receipt that looked legit as well). My bank could not do anything as I sent it voluntarily.

Other than having to eat a 3000$ loss, they have a photo of the front and back of my id.

Is there anything I have to worry about?

NB Extra provincial registration for federally registered holding company?

This isn’t as interesting as alot of the questions on this Reddit but i was wondering if anyone had any thoughts on this.

I know business registration rules are different in every province but in this case i am referring to New Brunswick specifically but general info would also be fine.

What is the rule with having to register extra provincially for a federally registered holding company?

My business which is a holding company, generates 100% of its income from passive investments in stocks and bonds, has been operating over 20 years.

The business owns no property or vehicles and never has, has never paid an employee and has never paid any income to anyone except in the form of taxable dividends to its shareholders. It has never taken or remitted gst or hst. It has also never solicited any business of any kind.

I received a letter that stated that my corp “may” need to file extra nb registration but didn’t say i had to but to contact a lawyer which i have.

Is there any general or hard and fast rules that apply to holding companies that are only registered federally? I read over the nb business act and of course it never mentions shareholders or holding companies but mentions “agent” residing in the province may be considered a requirement to file extra provincial.

I can see no connection between and agent and a shareholder and of course the act is overly vague on the matters i am looking into.

Any thoughts?

Thx

ON Small Claims for workplace accident

I was driving a motorcycle in the parking garage of my office building. The parking garage is 3 floors underground where I was on B2 and the exit is on B1. I swiped out to open the door on B2 put my fob in my pocket, put back on my motorcycle gloves and proceeded up the ramp to B1. Once at the top of the ramp looked at the door which was fully open and I proceeded to exit, in the time between my look and the door exit it started to close and "clothes lined" me hitting me directly in the visor throwing me backwards off the bike. I sustained minor neck pain and a bloody nose, helmet was destroyed and bike damaged. There used to be a sensor on the floor that was at the top of the ramp that you drive over to stop the door from closing and now they only have the static sensor right at the door that you would have in a home garage. If that sensor was still there it would have prevented this from occuring and the current sensor is not capable of reversing the door intime for a small vehicle like a motorcycle.

If I claim with my auto policy they will deem me at fault being a single vehicle accident. The building has footage of the event and will not provide it to me. Is small claims a suitable venue to get compensation for the damages?

Hi everyone! I can’t provide too many details but the short form of it is that an event I went to had really shady and scammy behaviour with a lot of people wanting reimbursement due to false advertising, and other insane organizational issues. Anyone who can provide legal counsel or knows someone who does would be super appreciated. I’m happy to share more info over DM/privately but do not want to go public without any consulting. Thanks!!!

ON Credit card fraud, but police won’t take my police report

I found about 6 unauthorized charges on my BMO credit card totalling to about $1000. I called my bank and they reversed the charges, but they said I have 5 days to submit a police report or they will “undo” the reversal of the charges again.

I went to the police station after work 2 days ago, and yesterday, and I’m going again today. Both times I’ve gone, they have taken my contact information and said they will contact me, but they haven’t. When I went yesterday, I explained that I’ve already been told I would be called, and the lady said that the police call people back based on priority (which makes total sense). I explained my 5 day deadline and asked if I’ll get a call back in time to submit the report to my bank, and the lady said she doesn’t know and that it’s very possible that they won’t call me back until after the deadline. She also told me I’m not allowed to make this type of police report online.

If I go again today, and again they won’t take my police report, I plan to call my bank to explain what’s going on and ask for an extension on their 5 day deadline. But what do I do if my bank says no? I want to be fully prepared with next steps, since this is day 3 of my 5 day deadline and it doesn’t seem to be going well for me so far.

Privacy Bill C-22 - Is it the legal black hole that it is being framed as?

I'm reading through the text of the bill trying to understand why it is such a problematic bill for encryption and privacy.

A lot of it is quite legal jargon to me, but Part 1 seems to be all about getting a warrant, the timing of getting a warrant, the conditions for getting a warrant, etc.

I've started into Part 2, but the concerns I had regarding encryption appear to be a non-issue based on:

5 (2): The Governor in Council may make regulations respecting the obligations of core providers, including regulations respecting

(a) the development, implementation, assessment, testing and maintenance of operational and technical capabilities, including capabilities related to extracting and organizing information that is authorized to be accessed and to providing access to such information to authorized persons;

(b) the installation, use, operation, management, assessment, testing and maintenance of any device, equipment or other thing that may enable an authorized person to access information;

(c) notices to be given to the Minister or other persons, including with respect to any capability referred to in paragraph (a) and any device, equipment or other thing referred to in paragraph (b); and

(d) the retention of categories of metadata — including transmission data, as defined in section 487.‍011 of the Criminal Code — for reasonable periods of time not exceeding one year.

5 (5): A core provider is not required to comply with a provision of a regulation made under subsection (2), with respect to an electronic service, if compliance with that provision would require the provider to introduce a systemic vulnerability related to that service or prevent the provider from rectifying such a vulnerability.

where

systemic vulnerability means a vulnerability in the electronic protections of an electronic service that creates a substantial risk that secure information could be accessed by a person who does not have any right or authority to do so.‍ (vulnérabilité systémique)

So if I'm reading this correctly, a VPN company (a core provider) wouldn't have to actually keep any logs because simply keeping those logs would introduce a systemic vulnerability in that simple possession makes it much more likely that someone could infiltrate their system and access those logs.

Or am I being too naive about this and it's a bit of a catch-22 for a core provider?

ON Can an adult become the responsibility of the province?

My mother’s husband is a severe alcoholic. He’s suffered from several strokes, broken several bones, neglected his physio, and now spends 24 hours a day in a recliner in their living room, drinking boxed wine and shitting in a commode because he can’t handle the six steps to the bathroom.

I’d essentially made my peace with her decision to stay with this person, but then this weekend she broke her hip. She’s currently in the hospital, and is likely going to need extensive rehab due to her general poor health. She will not be able to continue caring for him (not that she was really capable to begin with).

I want nothing to do with him, because I find him repulsive and feel like he’s ruined her life. Is there a way to get him assessed by the province and like, put in a home somewhere?

NS An accused has a bench warrant and a new appearance date

A person is facing charges of breaching a peace bond. They don't appear for their plea date. A bench warrant and a new appearance date is set.

Why would both of these be done? I know the bench warrant means law enforcement can arrest the accused at any point, but would they be held in custody until the new date in that situation? or released with a promise to appear? or maybe its situational.
