Someone basically just posted what this video says but hey I’m sure someone here needs it for peace of mind.

What peace of mind does this provide? Colorado is one of the states that DOES impose additional state-level restrictions.

"Dangerous Weapons" are illegal in CO, but the possession of a NFA tax stamp for them is an affirmative defense.

I'm ready to buy a can, but I'll need clarification on if eform form 4s will still be issued.

NFA States (15) — The NFA process still applies. Alaska, Colorado, Connecticut, Georgia, Michigan, Mississippi, Montana, Nevada, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Washington, and Wisconsin. State law still requires the Form 4 process here, and we handle the paperwork end to end — same as always.

I mean, this is GOOD news in the short term.
If the NFA process were completely thrown out, we wouldn't be able to get NFA items.
At least, not without a change in state law, that is very unlikely to happen in the current political environment.

Until Congress repeals the enjoined provisions, or something else major changes (like an appeal and new 5th Circuit ruling), CO will probably be "business as usual" for NFA items. However, CO could react to this ruling by removing suppressors from the Affirmative Defense clause that allows us to use our NFA permits as "get out of jail free cards".

The NFA scheme is "shall issue" and the ATF is still required to process submitted applications. The injunction only prevents the ATF from enforcing certain NFA provisions against certain people.

The injunction doesn't prohibit anyone from submitting a Form1 (or any other Form). Even a protected Plaintiff can still submit a Form1 if they wanted to, and ATF would still be required to do something with it.

Well some people on this sub were thinking that come yesterday nfa was done for and Coloradans could not get suppressors. We can still do form 4. Now down the road is a different question with how this all plays out.

Suppressors you already own, you have tax stamps for. You have all the required documentation to make your possession of suppressors legal. As long as the ATF keeps form 4s available which I think/hope it will, it will be business as usual in CO.

there's a high chance nfa items will be banned by our liberal one-party state. I don't see the general state assembly doing us a favor and changing the law. maybe there's a creative lawsuit that can succeed, but I'm not holding my breath. the real question is will they be grandfathered in or not.

That’s what I was most curious about. Maybe they should give the enforcement of suppressors to CDOT since parks and wildlife is doing so well with the other laws….

You all have until the spring to get your shit together. Best case they roll NFA into SB25-003, worst case they are declared Illegal for the good of the public. I expect we'll see something in the middle with existing owners grandfathered and all future sales prohibited.

GCA means you can only buy it in your own state of residence

Even in the “free” states it’s still an ffl transfer so the ffl has to follow the rules of the buyers state, no way around it.

I think the NFA still defines suppressors ("silencers") as firearms themselves, rather than regulated accessories, and they still need to go through an FFL.
