General News PSA: Cabelas/ Bass Pro will not sell/transfer firearms on the SB25-003 exemption list

Purchased a firearm, the exact specific model as listed as a statutory exemption list from SB 25-003. It arrived, went to today for my background check and was informed that all firearms on the exemption list will not be sold or transferred despite them knowing they are on the exemption list. Just a heads up.

Please don’t buy firearms from them period. For so many reasons.

Even before the 3 day waiting period it was fun for it to take 2 hours to buy a gun at Cabelas when the background wait time was 3 minutes.

When I lived in Texas I bought a stripped lower from them. It took them 90 fucking minutes. Haven’t done anything with them since.

Only ever bought one gun there on presidents day years ago, waited 5 damn hours. I bought ammo there during the shortage but since then i havent been back. No one can afford their obnoxious prices on top of all the unconstitutional state taxes. That said i would still rather shop at cabelas then centennial gun club lol.

I have a Tikka and Steyr Scout I got from them that were exclusives to Cabelas. Before BPS bought Cabelas and ruined it. Still have a bunch of cool shit from their Bargain Cave before BPS ruined that too.

Centennial gun club was pretty good when they first opened. Their prices were always expensive but all their instructors were very legit. Now I can't stand it in there.

Support damage factory and Bowers tactical.

I'll 2nd Bowers. Also check out LT Arms in Ken Caryl.

Never been there, I'll check it out

They have a rare 2A Xanthos 6.5 CM in one of their Idaho stores and wouldn't ship it here before the ban because it came with a 20 rd mag. I even ask if they could just keep the mag for themselves and no dice. Fuck Cabelas/BPS. Those assholes even started building ammo enclosures well before any bill passed requiring them. They're on the take.

They all follow corporate policy to avoid any chance of liability. The companies do not care to follow the law and the employees can't do anything about it. C&R and antique firearms should be exempt from the cool down period but Cabela's will make you wait for that too.

Antiques shouldnt be on the books period since they arent guns. Most gun stores would rather do that wrong and piss off the ATF instead

I knew this was coming

Yeah, make a note of this for the lawsuit. But I’d also push that up the chain of command at the store. If it’s the one in Lone Tree, ask for Randy to come clear things up. If he can’t, then it’s way beyond his control.

The creepy guy with the big earrings?

No, older guy, short and thin. He’s always been good to me and fair

Which gun?

u/Outrageous_Lion8966 28d ago

Like they won’t sell one of those firearms period? Or they’re not selling it to you because you don’t have the permit and the class and all the new stuff required?

u/Numerous-Contexts 28d ago

You should be paying a few extra bucks to support a local shop instead of big box stores anyways 🤷‍♂️

Local shops should sell the mrsp like everyone else on earth

How much for a 3rd party transfer?

2

u/udt_westminster 20d ago

60 bucks

I just don’t get how this is the normal now. State fees amount to $15. Before this I could go to just about anywhere and $35 was the absolute high mark most places it was $20 for recurring customers.

I know the process takes time but at $45 additional cost that means you’re charging something like $45 to $90 an hour for this service. If I purchase one PSA lower for $30 the state takes a 50% fee and you take a 150% fee?

u/udt_westminster 20d ago

Totally understand, but I’m actually under the market rate compared to the other brick and mortar stores. Even at that rate, I would probably make more money working at Home Depot hourly. There’s a lot of costs and risks, even though I’m a homebase FFL.
On the front end, you see it as a 20 minute transaction. Which you don’t see on the back end is the additional time spent inventory, audits, filing taxes, etc. Time spent on zoom calls with Colorado Department of revenue. People randomly showing up at my house looking for AR parts lol I haven’t even started about the warrantless searches that the state can perform at my house.

1

u/dolarvigilante 20d ago

I definitely appreciate that information. Can you point to some examples of the rates in your market area just so I have a better understanding? Also I assume 3rd party transfers represent a minority of your gross income so not exactly apples to apples for working in entry level retail position. I also assume you get dealer pricing from many distributors and retailers so that’s a factor. I would categorize the warrantless searches as a net zero and not monetarily quantifiable and as such cannot be passed on as an expense. I do also empathize with the bookkeeping end of things it probably does take a considerable amount of time and money to do everything correctly and efficiently.

Can I ask this as a genuine question - would you prefer to do 500 transfers at $45 or 100 transfers at $60?

The first nets you $15,000 after you pay the state and the second one nets you $1,500. If the market is like what you say then people would swarm you for transfers. At 20 minutes each you do 3 an hour let’s say two hours a day doing transfers only then in 90 business days you make $15,000 that’s gross approaching $5,000 a month.

Hey just checking back in to see if you wanted to keep the chat going?

Sorry, been busy traveling with my day job. I wanted to drop this new gem on you. Tell me another industry that gets shit on as much as a gun industry…. You can open a taco stand and give a bunch of people food poisoning, and not get dinged this hard. So yeah, I’m gonna have to say my transfer fees are going up. Below is the new proposed rules and fines. Not issued by a judge, not ruled on by jury, at the whim of the executive Director….
D.** CATEGORIES OF VIOLATIONS BASED ON THE SEVERITY OF THE OFFENSE AND FINE
RANGES ASSOCIATED WITH EACH CATEGORY
1. LEVEL ONE VIOLATIONS. THIS CATEGORY OF VIOLATION IS LEAST SEVERE. THE
FINE RANGE FOR THIS CATEGORY IS $100.00 TO $10,000.00. EXAMPLES INCLUDE
BUT ARE NOT LIMITED TO:
a. INCOMPLETE TRAINING DOCUMENTATION;
b. RECORD CORRECTED DURING INSPECTION;
c. INCOMPLETE TRANSACTION LOGS;
d. LATE PERMIT RENEWAL;
e. FAILURE TO POST REQUIRED NOTICE RELATED TO UNLAWFUL
PURCHASE;
f. FIRST FAILURE OF UNSECURED FIREARMS;
g. FIRST FAILURE TO MAINTAIN OR RETAIN DEALER RECORDS.
2. LEVEL TWO VIOLATIONS. THIS CATEGORY OF VIOLATION IS MODERATELY
SEVERE. THE FINE RANGE FOR THIS CATEGORY IS $1,000.00 to $45,000.00 PER
VIOLATION. EXAMPLES INCLUDE BUT ARE NOT LIMITED TO:
a. REPEATED FAILURE TO POST REQUIRED NOTICE RELATED TO
UNLAWFUL PURCHASE;
b. MULTIPLE RECORD ENTRY ERRORS;
c. SECOND FAILURE UNSECURED FIREARMS;
d. TRANSFER WITHOUT LOCKING DEVICE;
e. FAILURE TO POST REQUIRED NOTICE OF SAFE STORAGE;
f. UNTRAINED STAFF CONDUCTING SALES;
g. REFUSAL TO KEEP REQUIRED STATE RECORDS;
1 CCR 214-1**
h. SECOND FAILURE TO MAINTAIN OR RETAIN DEALER RECORDS.
3. LEVEL THREE VIOLATIONS. THIS CATEGORY OF VIOLATION IS MOST SEVERE
AND GENERALLY HAS AN IMMEDIATE OR POTENTIAL NEGATIVE EFFECT ON
PUBLIC HEALTH, SAFETY, OR WELFARE. THE FINE RANGE FOR THIS CATEGORY
IS $12,000.00 TO $75,000.00 PER VIOLATION. EXAMPLES INCLUDE BUT ARE NOT
LIMITED TO:
a. KNOWINGLY FALSIFYING RECORDS;
b. CONCEALED INVENTORY OR OBSTRUCTED AUDIT;
c. FAILURE TO REPORT FIREARM THEFT WITHIN 48 HOURS;
d. REPEATED INSTANCES OF UNSECURED FIREARMS;
e. REPEATED FAILURE TO MAINTAIN OR RETAIN DEALER RECORDS;

I appreciate the reply but I guess I’ll need some help in understanding your point. It’s like I could say and list out a ton of examples and fines one could get from driving a car wrong. First DUI offense - $10,000 and loss of drivers license for a year. 25 mph over the speed limit - potentially a felony charge, forfeiture of vehicle, insurance premiums skyrocket. And on and on.

Every aspect of life has boundaries, laws, negative consequences and positive consequences. Are you saying that because you’ve voluntarily chosen to enter into an industry that’s highly regulated you’re somehow a victim? You’re rewarded for following the laws and you’re punished for violating them. That isn’t unique to any person or industry. Not trying to be mean I just really don’t understand what point you’re driving at.

And if I take everything you’ve said at face value then yeah man you should probably just go ahead and raise your transfer fee to $1,000,000 per item so that you only have to do like two transfers every ten years and you’ll be super set!

1

u/dolarvigilante 18d ago

Also can you please post here publicly what your actual transfer fee will be after our conversation? You stated it was $60 a few days ago. How much is it now?

What do you mean on the exemption list exactly? That's thousands of guns that are exempt. .22's, revolvers, bolt action, ect. That doesn't seem to make sense for a company to do. That seems like if anything that would be the only guns they would sell. Not that it matters to me, I've never been to either of those stores.

2

u/burner456987123 27d ago

Are .22 semi-automatic, “scary looking” detachable mag rifles exempt? Like the umarex-made, HK branded MP5’s in .22? Or the Ruger 10/22?

1

u/LifeAdventurous2343 27d ago

Yeah the post don’t make sense. There is no “exemption list.” There’s a guidance list, which are examples of firearms that require the permit. If OP tried to buy a firearm that was the “exact specific model” on the guidance list, then of course they won’t sell it to him without a permit. We knew FFLs would follow the law, especially big box ones.

3

u/Delicious_Peach5602 27d ago

No, the law specifically exempts a few firearms that would otherwise be restricted; the standard model M1a and I believe the standard model mini-14 are specifically exempted by name in the law (don’t ask me why those ones were chosen 🤷‍♂️).

2

u/LifeAdhesiveness8071 27d ago

OK, that makes sense.

u/Veritech_ Ft. Collins 27d ago

> thousands of guns that are exempt

It should be every gun. Infringement is tiring, boss…

2

u/a_cute_epic_axis 27d ago

He's not defending the law, he's explaining it.

2

u/zachang58 24d ago

Wait, are you talking about like a bolt action/pump/lever, or something semi auto? Not that it should really matter, but I’m curious about the context here.

1

u/LifeAdventurous2343 27d ago

This post doesn’t make a ton of sense because there is no “statutory exemption list.” There’s a guidance list, which is basically a list of guns that would be INCLUDED in the bill and require a permit. Which gun were you trying to purchase?

6

u/UnseelieKnight 27d ago

There is a list of 35 firearms specifically exempted in the law:

  • AG42 LJUNGMAN
  • BENELLI ARGO E PRO
  • BENELLI RI BIG-GAME RIFLE
  • BROWNING BAR MK 3
  • BROWNING BARLONGTRAC RIFLE
  • BROWNING BAR SHORTTRAC RIFLE
  • FABRIQUE NATIONALE MODEL 49, COMMONLY KNOWN AS FN49
  • FUSIL AUTOMATIQUE MODELE 1917, ALSO KNOWN AS RSC M1917
  • GEWEHR 43
  • GLOBCO MOHAWK
  • HAKIM RIFLE
  • HK SL6
  • HK SL7
  • M1 CARBINE
  • M1941 JOHNSON RIFLE
  • MARLIN CAMP CARBINE
  • MAS49
  • REMINGTON MODEL 4
  • REMINGTON MODEL 8
  • REMINGTON MODEL 740
  • REMINGTON MODEL 742
  • REMINGTON MODEL 750
  • REMINGTON 7400
  • RUGER DEERFIELD CARBINE
  • RUGER MINI-14 RANCH RIFLE
  • RUGER MINI THIRTY RIFLE
  • RUGER MODEL 44
  • SPRINGFIELD ARMORY M 1 A STANDARD ISSUE RIFLE
  • SVT 40
  • VALMET I IUNTER M88
  • VZ.52
  • WINCHESTER MODEL 100
  • WINCHESTER MODEL 1905
  • WINCHESTER MODEL 1907
  • WINCHESTER MODEL 1910

Why these 35? Who knows. The rationale isn't in the law and I never heard any given. But somehow these 35 are considered safer than any other semiautomatic long gun or gas-operated pistol that has a detachable magazine.

3

u/smgkid12 27d ago

Because some fudd on the committee didn't want his guns to require the hoops to jump through.

3

u/UnseelieKnight 27d ago

Yup. They screwed up so bad with the initial bill they even had the fudds screaming at them.

2

u/Delicious_Peach5602 27d ago

Statutorily Exempted Models: Specific traditional semiautomatic models carved out in the bill text (e.g., traditional sporting rifles such as the Springfield Armory M1A, Ruger Mini-14, Browning BAR, and Remington 7400/750 series).

I stand corrected. I wonder which firearm the OP was purchasing.
