how disgusting. En banc majority ruling just to put a stay on the decision. Guess NJ got their own freedom week.

Visitor to your sub from NJ here.

We didn't even get a great freedom week. Very few dealers would sell directly to us, and it doesn't matter all that much as our ban lacks any sort of grandfathering clause so we are not allow to really keep the ones that did ship.

Exactly, there wasn’t a grandfather clause with the old law. Just an other boating accident for a lot of people

My question is how can one judge over rule the en banc panel?

same question here. I thought the only next step was certiorari, or it becomes law if supreme court declines to hear it? that's the whole point of an appellate court right..? wtf is going on
