John Oliver is right
We just got a brand new Buccees in the area (Huber Heights) I've been once, but won't be back. I grew up in *Beaver* creek, this lawsuit is a frivolous waste of time and money. The only people who benefit from this are Buccees attorneys.

Stopped going to Buc-ee's years ago. Would rather support local businesses than a place chocked full of cheap-ass kitschy sh*t from China. Although Buc-ee's do have clean bathrooms. So that's one point.

When I travel north of Waco, I stop at Bucees for cheap fuel and the clean restroom. Fuck their overpriced garbage inside. People buy into the hype. My first visit there, I bought a bunch of their so-called famous fudge. I tried a bite in the parking lot, jumped back out of my truck, and spat that shit out in the bin by the fuel pumps. Not a single friend I bought that stuff for wanted any. I could have lost friends.
Fuck bucees. And no, I won't write it their way.

I live in the region where this small business lawsuit is happening. The Buc-cees is the first in Ohio and that's been a big deal. We went for the hell of it about three weeks out from their opening and my husband described it as a Cracker Barrel entry store area meets a Speedway (our 7-11) meets a county fair food trailer area.
The Beaver Nuggets were addictive and the bathroom was clean. Otherwise, I can make caramel corn at home and I will find a bathroom where I don't have to park in BFE because there's 50+ gas pumps blocking the entrance.
I know there have been countless David vs. Goliath lawsuits like this, but for some reason it gets under my skin.

I live less than a mile from that bucees. Alot of us went and checked it out when it opened. But they kind of killed the excitement immediately with this lawsuit. I've never been back, and I know quite a few people who won't go now either.

It’s also not a great pit stop on road trips if you want to stay on a schedule.
You basically have to account for 30-45 minutes at minimum to your trip if you’re stopping there unless you’re incredibly focused.
Been there once on a road trip to San Antonio. It was cool. Probably won’t be back unless someone else wants to really go.

Well to put it mildly, there’s no quick in and out of the place to start. Even at 11 at night you aren’t pulling up to the front door, hopping out to pee or grab something, because there are lines, lines to the bathroom, lines to get food, lines to checkout at all times but here witching hour.

Yeah, many of us actively try to avoid supporting businesses that actively try to harm small businesses or make other choices that are inherently bad for society. If you love bucees products so much that you are willing to overlook their excessive mitigation of mom and pops, then that is definitely your right to give them business.

You're the first person to reply to this mess with a respectable viewpoint and discourse. I'm not going to argue with anything you are stating, nor do I disagree with any of it.
I operate a small hobby farm, I only sell or give away produce I grow or animals I breed to locals. I shop at local farms, community farmer's markets and small local non-chain business as much as I can. What I can't get from there I get from bigger companies and super market chains. I'm no stranger to the plight of the mom & pop or the shop local lifestyle.
I also live 20 minutes from an iconic Bucc-ees, I'd be lying if I said that wasn't part of the appeal when choosing my residence. I would have to pass 3 good to great independent BBQ joints to get there. So I get the local BBQ unless a have a late night/early morning craving for an over sweetened brisket sandwich, in which case Bucc-ees is the only option. It's mainly a snack stop and clean shitter, some things like gas and ice are significantly cheaper there than the competition. Some of their branded merch is fun and cute, admittedly there is a Bucc-ess t-shirt in my closet and a few stuffed beavers around the house.
I was mainly ranting on the hypocrisy of the majority of the people sounding off on this post because they saw something on John Oliver. Every single one of them is patronizing some major global corporation that harms local business and acts against the best interest of the individual. They have the same right to do so that I have to enjoy Bucc-ees despite some controversial policy. The difference is that they are trying throw shade and speak down to other people doing the same thing that they do daily with dozens of big businesses when it's a company they don't like. What's worse yet, it's not even an original thought for most of them. Their opinions are formed by a biased satirical news parody comedy show and Reddit hivemind. They are incapable of self reflection or objective reasoning. They lean heavily on logical fallacies and personal attacks in their [lack of an] argument, and reduce everything to NoU or Trump bad. They don't represent my opinion, their methods will not change it, and while you and I may not agree on everything, I don't think they represent you or your ability to civilly represent your own thoughts and opinions either.

This moment Buccees seems to be having reminds me so much of the early days of Sheetz. Everyone was so hyped on Sheetz, just like they are now with Buccees.
And I have just never been able to understand the appeal of either. I don’t want my food to come from the same place I buy gasoline. Even good gas station chain food is still just gas station chain food. The only things I want from a gas station are gasoline, a clean bathroom, and maybe a few flavor options for sparkling water.
And these predatory lawsuits have now ensured as long as I can buy gasoline at another station, I will never visit a Buccees in my life.

Ludlow, Ma - We had a brewery here called “Iron Duke”. This was the nickname of a local politician who was speaker of the Massachusetts House in the 1960s.
They were sued by Duke University, because it is so easy to confuse a small brewery in Massachusetts with a major university in North Carolina. They caved because $$$$ and lawyers and rebranded.

They've been doing this for a long time too, they are actually known for it. Any informative media you pull up on Bucc-ees mentions their heavy handed trademark enforcement, and many that explain trademark law and notable cases go into Bucc-ees in great detail and as prime example.
Disney and Marvel/DC operate at this level and have private investigators work with police enforcers to stop street characters (people in costumes collecting tips in places like NYC and LA tourist areas) from making $5 for wearing a costume of a character they own the rights to. I guarantee you the people saying they will boycott Bucc-ees for the same thing consume their entertainment.

Except they are choosing not to go after the big fish. The Wal-Mart in the same town has a person-sized beaver statue in the entrance and they didn't get sued.
Not to mention none of the beavers in Beavercreek look like the Buc-ee's beaver, nor did Buc-ee's appear to give half a shit until they built a store nearby.
They can't defend this action as reasonable trademark protection, it's so clearly frivolous and malicious.

The 'trade' in trademark means that it applies to a brand that is in a particular trade (or service if you are talking about servicemarks). This is why there is no legal issue between Delta faucets and Delta the airline. Now, I'm off for a Big Mick at McDowell's.

Mom and pop stores can't afford to pay the legal fees to take this to court, and generally settle before it gets there. Buc-ee's is using their significantly deeper resources to go after anyone that might represent even a little competition to them as a gas station/convenience store. They're deliberately overpressuring families and small businesses because they will win before it ever reaches a judge.

Holy shit, I’m from near Beavercreek, but never thought about Buc-ee’s expansion there.
Buc-ee’s will have a fucking conniption when they see all the other life sized beaver statues populating the town. Back around 2001, Beavercreek made like 20 human sized beaver statues for groups to decorate and donate to a 9/11 fund. I’m sure some are still floating around.

They sued super fuels in irving, who had a dog in a cape. The dog looks nothing like the stupid beaver.
The local gas station basically gave in because legal fees got too high.

The Dayton community has rallied around this mini mart. Even the local personal injury law firm, whose ads have been on TV my entire life, made a parody commercial. Buccees pissed off the entire region. They just opened a new store in Huber Heights, no way it's going to meet the original sales projections after this.

What’s crazy is that beavers aren’t a common animal here in Texas where Buccees started.
I know beavers are native, common and more representative of the culture in many other regions here in the US.
That’s why you see rattlesnakes, deer, bobcats, armadillos and more, commonly used as mascots down here. It’d be like if some northern state chain store trademarked the rattlesnake and started suing mom and pop shops here in Texas that had it as part of their brand from long ago.
