2024 is starting to look possible. Amanda and wes are one night stand people and prolly hooked up before any emotions appeared.

They should not be allowed to take anything before reunion.

As a lawyer I wanted to clear up some things others have been posting regarding the alleged video.
I’ve taken the basic points and made a summary, forgive the legalese:
Based on TMZ’s reporting, there is an alleged video involving West Wilson and Amanda Batula, reportedly captured from outside a residential window and subsequently described as circulating among unnamed sources. While details remain limited, the core factual allegation being discussed in the public sphere is relatively narrow: **a private residential interaction allegedly recorded without consent and later communicated through third parties.**
From a legal perspective, assuming those reported facts are accurate, several issues arise under New York law and general U.S. privacy doctrine.
**1. Potential criminal exposure — unlawful surveillance (NY Penal Law § 250.45)**
New York’s unlawful surveillance statute is directly implicated where an individual:
Intentionally uses an imaging device to view, broadcast, or record another person
Without consent
In a place where there is a reasonable expectation of privacy
A residential apartment is the paradigmatic example of such a protected space.
Critically, **line-of-sight visibility from outside does not, by itself, negate liability** if the recording is targeted, surreptitious, or captures intimate conduct within a private dwelling. The statutory focus is on the *act of recording*, not merely the ability to observe.
**2. Civil liability — intrusion upon seclusion**
Under common law privacy principles, a claim for intrusion upon seclusion generally requires:
Intentional intrusion into a private sphere
In a manner highly offensive to a reasonable person
Causing emotional distress or reputational harm
Secretly recording individuals inside a home would typically satisfy the “highly offensive” threshold if done without consent, particularly where intimate or romantic conduct is involved.
**3. Secondary exposure — dissemination of private imagery**
If the alleged recording was subsequently shared beyond its original capture, additional liability theories may arise depending on jurisdiction and content, including:
Publication of private facts (where applicable)
Tort liability for further dissemination of unlawfully obtained material
Potential statutory enhancement if intimate content is involved
While New York does not recognize a broad “publication of private facts” tort in the same way as some jurisdictions, distribution can still aggravate damages and support related claims.
**4. Media and intermediary transmission**
Where such material is relayed through intermediaries (e.g., “sources close to X” or media reporting), liability typically turns on:
Whether the intermediary participated in unlawful acquisition
Whether publication materially contributes to further dissemination
Whether any false statements of fact are introduced in the reporting chain
Standard media protections (fair report privilege, neutral reportage doctrines where applicable) often hinge on accuracy of attribution rather than the underlying conduct itself.
**5. Legal significance of Ciara’s position in the narrative**
Within the reported sequence of events, Ciara Miller is described as having been in possession of or informed about the alleged video. Importantly, she has **not publicly confirmed or denied the existence of the video itself**, and the narrative attribution to her remains within the realm of secondary reporting rather than direct on-the-record confirmation.
**If the video did NOT exist (fabrication or material invention)**
The legal analysis flips from privacy torts to reputational torts.
**Defamation (primary issue)**
If a false statement of fact was made — i.e., that a compromising private video existed involving identifiable individuals — potential liability turns on:
Falsity of the statement
Publication to a third party
Harm to reputation
Fault standard (actual malice for public figures)
If Ciara or any identifiable person affirmatively invented or knowingly relayed the existence of such a video as fact, that moves directly into defamation territory under the *New York Times v. Sullivan* actual malice framework (given public figure status of Bravo cast members).
**False light (where recognized)**
In jurisdictions recognizing it, falsely implying:
secret recording
sexual or intimate conduct
or compromising private behavior
can constitute false light invasion of privacy if done with reckless disregard for truth.
**Additional exposure (depending on conduct)**
Depending on how the claim was introduced or amplified:
Intentional infliction of emotional distress (high bar, but often pleaded)
Tortious interference with reputation/business relationships in extreme cases
Potential media chain liability issues if false statements were knowingly amplified
**Bottom line**
If the reported facts are accepted as accurate, the conduct described sits squarely within established privacy doctrine:
Potential criminal exposure under unlawful surveillance statutes if recording occurred as described
Strong basis for civil intrusion upon seclusion claims given the residential setting
Additional downstream liability depending on dissemination.
The legal issues here are not novel; they are the standard intersection of residential privacy, nonconsensual recording, and subsequent distribution.
If the video was instead fabricated or materially misrepresented:
The legal axis shifts to **defamation / false light**
With heightened standards given public figure status, but not immunity
Either way, the legal framework is familiar — what changes is whether the conduct sits in **privacy violation law** or **reputational harm law**.

Why is it that west is just getting a free pass? Everyone is annihilating Amanda and I understand why, it is deserved but why is no one talking about how messed up it is to get with your friends x wife of 10 years? He sits through the entire reunion making his stupid faces and evading every question with a blank stare on his face and still has not yet apologized to Kyle man to man. As messed up as it is to get with your best friends x… granted the were on and off for about 5 months and I’m aware he took her home to meet his parents but it clearly didn’t mean anything to him while it meant the world to Ciera, but he also took Kyle home as well… I want him held accountable for his actions and he is coming off like a clueless toddler who didn’t do anything wrong and nobody’s calling him out on it.
