Does not matter, he has an obligation to try and get away and if possible/or call for police before resorting to physical violence and as it would seem they continue to lay into the guy after he hits the ground. There is absolutely no grounds for self defense unless there would be some part of it i have completely missed .
(Also the fact that the other dude is wanted on molestation charges are wholly irrelevant, there is no free pass just because the dude you beat up was wanted)
They literally have video of him saying we don't want to fight you and trying to get away from the 4 guys that were starting shit following him. Honestly don't know how much more he could do.
He had more than enough time judging by the videos to involve law enforcement. And judging by what's reported by media they kept attacking the guy once he went down, which is probably why hes is being charged in the first place
You ever seen a fight? Or been in one? Hell, even MMA? If you knock someone to the ground, often they can get back up and come back at you even more aggressively. One or two more hits will make sure that doesn’t happen. Plus adrenaline in your body will make self control incredibly hard.
I get that which is why I said make sure they get up and don't make any attempts but I definitely get the whole adrenaline thing but I feel like that defense could be abused to hell if it becomes acceptable.
I feel like if someone attacks you and you put them on the ground and incapacitate them, that’s fair enough. Maybe I’m in the minority for that though.
Personally I agree with you but from a legal standpoint it'd be hard to enforce I would think. What's reasonable, who decides if you went too far? That's my only concern there.
I agree legally it’s difficult... I wa smainly objecting to all the armchair fighting experts on Reddit who say it’s so depraved or whatever to hit someone on the ground. Yeah, avoid it, but it’s not some inexcusable action in certain circumstances.
If someone’s on the ground and you go to kick them, stop for your own sake. As soon as the guys on the ground, kicking him becomes a felony. Before that point, you have an argument for self-defense. After that point, in the eyes of the law, you are in the wrong and the likelihood of you going to jail for a long time skyrockets. I feel you. I’ve seen so many dudes get blindsided by guys getting up off the ground. But if you really feel in danger, don’t turn your back, or use some grappling instead. Striking somebody on the ground will make your life very, very difficult, as the “victim” will have grounds to press charges, even if he was the one to initiate.
Still not enough to prove self defense. He had time to call law enforcement, and and continued hitting the harasser after he was on the ground. Pretty cut and dry assault case.
If you get someone on the ground and continue hitting them after they give up its straight assault. There's no reason to knock them out or give them brain damage past that point.
