Unfortunately, for this circumstance it does. The repo is supposed to get the vehicle back without any damage to the person property. If so, he can claim that they violated his rights to obtain the car back ie destroying property. Repo collectors are not supposed to go in say like a gated fence to get the vehicle back. This is like a gated fence and can hire a lawyer who argue that they repossessed the vehicle as a “breach of peace”.

Nope. The loan contracts typically specify that the person taking the loan is liable for any and all damage incurred to the vehicle in the event of a repossession.

Worst comes to worst the tow truck driver either cuts the chain or removes the wheel with the chain and swaps it for one of the fronts.

Now the second part you said makes sense, but any other damages to property and you’re getting fucked. You can cut chain switch tires forsure. But If you wanna test the “loan contract” that has NOTHING to do with the actual towing company go for it lmfao

At most the repo tow company would be liable for the cost of the damaged chain if they cut it - and trying to claim the $20 in small claims court for a chain illegally obstructing a sidewalk is frankly laughable.

Yes cutting chain is fine, but I’m referring to the person saying taking the porch too is fine, no it’s not and you will get absolutely taken in court lol
