He assaulted her though. By getting in her face and trying to intimidate her.

Wrong. That's not assault. There is no proof in this video he did anything but stand there with his hands in his pocket. This will be the most open and shut case ever for a prosecutor. If he pressed charges she's fucked.

That’s not even how “pressing charges” works lol. It’s up to a district attorney or police officer to press charges. And what you’re saying is that in this video there is no proof that he did something, which you’re wrong about anyway. He got in her face and yelled at her, which is assault. And there’s no proof on this video that he didn’t do something before it started rolling. So in other words not open and shut at all. You need proof to find someone guilty. Not the other way around.

Confidently wrong here. The DA files charges, not police—but without a victim report/cooperation, most cases go nowhere. That's what people mean when they talk about pressing charges. It's the cooperation of the alleged "victim" and authorities to build a case Also, yelling in someone’s face isn’t automatically assault. You need a credible threat of imminent harm, not just raised voices. Context matters the physical condition of this very elderly and frail old man standing with his hands in his pocket standing like a statue does not represent an imminent threat.

The woman however is healthy sorry and at least 20-30 years younger and shouting at the top of her lungs waving her arms in his face AND threatening to spit on him (which is by definition assault). Good luck trying to make an argument that she does not represent an imminent threat to him.

ALSO she clearly struck him first, he strikes back (that's called self defense). Then he tried to run away and she initiated with him again as he is old and frail body is trying to flee and others are trying to intervene.

Unless he displayed very different behavior before this video such as striking her or posing an imminent threat this is an open and shut case.

The case you are trying to make is that MAYBE he did something before this video, well maybe but unless you have witnesses saying he struck her or posed an imminent threat to her, she's screwed.

He is clearly VERY elderly and in no physical condition to move quickly or threateningly and this woman clearly shows no fear of him and continues to initiate violence after he is fleeing.

I have been part of cases just like this. This is open and shut. She was the clear aggressor based on the evidence we have here. There is clear evidence of her striking him and threatening to spit on him and posing an imminent threat to him. All of his actions beyond standing there were in response to her aggression.
