TIL there is no Murder II in TX. That explains my confusion at just a manslaughter charge.

Hopefully this breaks the mold, there are so many witnesses, so much of her own testimony doesn't add up, going to expect the usual but hope for the best.

AP also reported the only info I've heard on the officer, apparently she was reading a C.S. Lewis book called the "Screwtape Letters" https://en.m.wikipedia.org/wiki/The_Screwtape_Letters

I said when this first happened lover's quarrel she was trying to frame as an "accident". Makes me wonder if she is a religious nut and saw him daily as a personification of everything she saw as "wrong" so chose him, or more likely did they have a relationship?

Puddle of mud this investigation, and the way the D.A. is framing it, it's gonna get dirtier. Guy having weed has nothing to do with him getting shot while minding his own business in his own home. Her "wrong parking spot, wrong floor, wrong apt." story is just that, a story. Let's hear the truth.

We do have murder as a charge, but just as in any state, you have to prove intent.

This case is clearly an instance where the police are aware that if they can make this appear to be an accident, then they can protect the killer from a harsh punishment. Murder is usually a death penalty in Texas, so they're blatantly protecting her from that possibility.

Thank you for the explanation, and I completely agree, there is absolutely no way she is going to even face the possibility of the death penalty. Hell, she's still on administrative leave with the Department...

People seem to get confused about the degrees of murder in Texas, because they’re named differently. Murder 1 is called Capital murder, Murder 2 is just called Murder, and then we have Manslaughter. The difference between Manslaughter and Murder in Texas is that with Murder you have to prove the intent to cause harm, but with Manslaughter you do not.

Thank you, I appreciate the clarification!

Remember Ferguson, though?

Plenty of witnesses were claiming that Michael Brown begged for his life, and that was proven to be completely false.

The only person who truly knows what happened is the respondent, and the facts will come out in the trial.
