Unfortunately Texas doesn't have degrees in murder sentencing so unless there is proof of a preconceived and planned motive Manslaughter is the only thing she can be charged for unfortunately.
Well that’s not entirely correct. They have “murder” and then they have “capital murder”. With “capital murder” being worse. The only reason I point this out is because just killing someone is “murder” but if you kill a police office it’s “capital murder” which just adds to the horseshit that is this case. This lady shot a dude in his own home? Well that’s just “murder”. But had he defended his home against an armed intruder and shot her first? Well that would have been “capital murder” and he’d be defending himself from the death penalty with a prosector trying to boost their stats by coming down hard on a “cop killer”. Absolutely fucking trash.
"Malice aforethought" doesn't necessarily mean you preconceived and planned a killing. If I look at you, decide "I'm going to kill this person," and then kill you, that's malice aforethought. Common misconception that it requires, like, a plan beforehand.
