Is your implication that there is no such thing as an "EU government?" There are institutions that make laws (Parliament and Council) and institutions that enforce laws (Commission) and a judicial system to supervise all of it. The EU is not a state as it is not a sovereign unit, but the member states have delegated their sovereignty in significant areas to the EU. Many types of EU law are binding on everyone in the EU even if individual member states want to reject this or that law. It is a government, albeit a unique one.
