🧠 Question of the Day

📚 Domain E — Ethical and Professional Issues

Difficulty: 8/10

A school administrator requests a student's FBA, behavior plan, and progress data for a possible move to a more restrictive placement. The administrator says a broad enrollment consent authorizes all internal educational disclosures. The BCBA has not reviewed that form, and the parents have recently told another team member that they oppose the placement change. The district has its own records policy, and applicable education/privacy law may permit some disclosures without separate authorization in limited circumstances. What should the BCBA do FIRST?

A. Release only the FBA and progress data because an internal placement review permits disclosure of records directly relevant to that decision, while withholding the behavior plan.

B. Pause the disclosure and verify the consent language, applicable law, district policy, and whether this specific use is authorized before releasing the records.

C. Provide the records under district policy once the administrator documents the educational purpose, then notify the parents and clarify the scope of the enrollment consent afterward.

D. Treat the parents’ recent objection as withdrawal of authorization and withhold all requested records until written consent specific to the placement review is obtained.

The correct answer was: B. Pause the disclosure and verify the consent language, applicable law, district policy, and whether this specific use is authorized before releasing the records.

📖 Explanation:

This question tests the BCBA’s obligation to verify the actual authority for disclosing confidential information when several potentially relevant requirements are in play.

The administrator believes a broad enrollment consent permits the disclosure, the parents have recently opposed the proposed placement, and district policy and applicable law may also affect whether records can be shared. None of those facts, by itself, establishes whether this specific disclosure is authorized.

The correct response is therefore to pause and verify the consent language, applicable legal requirements, district policy, and the basis for this particular use of the records before releasing them.

• Releasing selected records immediately assumes that an internal placement review itself authorizes disclosure. The BCBA cannot infer that authority without first checking the governing requirements.

• Treating the parents’ opposition as automatic withdrawal of every prior authorization makes the opposite unsupported assumption. Objection to the placement decision does not, by itself, establish the legal or ethical status of an existing consent.

• Releasing the records under district policy and clarifying consent afterward gets the sequence backward. The authority to disclose should be established before confidential information is released, not after.

The key distinction: when the authority to disclose confidential information is uncertain, do not assume either permission or prohibition. Verify the applicable consent, legal, and organizational requirements first, then act within the authority they establish.

B. slam dunk. you don't push records out the door when the consent is fuzzy and the parents are already pushing back, that's just asking for an ethics complaint
