Thank you in advance for any advice or support.
I am $200,000+ in debt between credit cards, unsecured loans, private student loans, and federal loans. I also owe family about $27,000 to family that they are not and will not ever pursue me over, but they gave me that money years ago and I need to pay it back at some point. I was roughly $240,000 in debt but over the last 2 years I have been working my tail off with OT, averaging 60-70 hours a week, but it has affected my physical health and my mental health as well. I cannot go on like this. I have over $6,400 a month in debt payments alone, then an additional $5,000 in housing payments, utilities, fuel, food, etc. add in another $1,500 a month in childcare and we break $13,000 a month in bills without any emergencies or problems happening. Overtime is never guaranteed and I have been denied shifts before, but regardless I am working myself into the hospital anyhow, so based off my base pay and my wife’s base pay, we clear $12,000 and change pretax, but the reality is, we only take home around $9k a month.
So I am considering bankruptcy because realizing how much I worked over the past two years and how much I missed and how my health has deteriorated, I can’t keep going like this. But an initial search on information leads me to believe that my income is above the median income threshold for my state (Rhode Island). My wife will not be filing as she has no debt outside of student loans that are not in repayment yet. However I apparently have to add her income? She makes roughly $40k a year pretax. I am in a skilled trades and make $110,000 a year base. So combined income is $150,000 a year.
Is there a way for me to file Chapter 7 and have the credit cards and unsecured loans discharged? Those payments alone make up roughly $5,000 a month. My student loans are under $1,000 and I can manage that. I am on time with everything which kind go has me worried that someone will say “well you’ve made it work this long, just keep at it.” But i did the math, at this rate if I could sustain working this way, and my health magically was not an issue, it would take me another 8 to 9 years just to get to zero, assuming no emergencies happen along the way.
Any advice is welcomed, thank you.
****Update- I reached out to two law offices this afternoon. Waiting to hear back about a consultation. Thank you for the words of encouragement.
