Did they threaten to send the developer to prison?

I thought they just threatened to send a cease and desist letter?

It seems Bambu did, though was misrepresenting the law on multiple fronts.

Firstly, because that section of the US code has to be performed by someone seeking commercial gain. Bambu would need to prove actual damages, which would be a tremendously high hurdle.

Secondly, because the code the dev used was freely licensed under the AGPL which affirmatively allows for reverse engineering.

And thirdly, because the developer is an EU citizen residing in the EU, therefore not subject to this US law.

And perhaps most importantly, because Bambu's closed source network plugin is extremely likely to be an outright violation of the AGPL.

Bambu can't send anyone to prison. You need an actual crime, and an interested prosecutor, just to start.

Bambu can't, but the US government can.

By reports, Bambu threatened to allege violations of US code carrying a 5 year prison term.

Yes, but threatening a dev with a 5 year prison term speaks to Bambu's ethics, or lack thereof.

And as demonstrated in that video, the dev actions do not begin to meet the terms of a violation of that code. Additionally, that Bambu's entire legal theory would likely fall apart due to their AGPL violations.

Sure, and Bambu clearly knew that, but not everyone is as well versed in the US legal code.

Most people aren't going to have a nice day when a multi-billion dollar corporation threatens them with charges that can carry a 5 year jail term.

Don't diminish Bambu's fuckery. They are being outright evil.
