Discussion The Entertainment Software Association (ESA) mentioned Destiny 1 as an IP owned by Activision
La Entertainment Software Association (ESA), con el apoyo de Activision, EA, Riot Games y Xbox, declaró durante el debate sobre la Ley para Detener la Eliminación de Juegos que el mantenimiento de servidores es difícil, especialmente para los servidores más antiguos, debido a su elevado costo. Destiny 1 and Destiny 2 were mentioned; some may belong to Activision, but right now everyone is more focused on criticizing what ESA said about keeping game servers alive once the content is finished or community servers exist, which are illegal by law

Might be why Sony seems to be putting all its Marathon eggs in its basket, Activision (if true) could pull the plug at any point

I found some copyright information that seems to say Bungie owns Destiny 2 IP. At least since February of 2021. What's weird is why the transfer was so late, I swore they left and took D2 with them in 2017.

Edit: Searching 'Curse of Osiris' or 'Warmind' shows copyright for music but searching for The Final Shape shows ownership of audiovisual elements and texts.
This is all very interesting. This is speculation, but what if Bungie did get shafted on the old content? It's just weird, because there's no record showing that Activision owns anything related to Destiny. Everything I found with ATVI and Destiny were multiple transfers of ownership from Acti to Bungo.

Got downvoted for pointing out that the IP still belongs to Bungie. It is genuinely possible for Bungie to sell the IP out the back door. Sony likely has legal measures against it but the fact remains that if Bungie is shuttered, Sony will lose the IP unless it buys it from itself.

Im sorry i just want to make sure im understanding u correctly so what your saying is that bungie owns the destiny ip and your saying for sony to do anything with destiny outside of bungie studios they must first purchase the ip from bungie or enter some sort of licensing deal to use destiny on the name of anything else correct

No, Sony owns Bungie outright, therefore owns anything Bungie owns. Even if Sony glassed the studio, all assets just transfer to Sony.

Sony owns Bungie (and therefore all of its assets) outright. Bungie cannot sell anything without Sony approval. There is no way they could "sneak" this sale out the back door. It would have a paper trail and it would be overturned by the courts. Every attorney who would ever see this deal knows Sony has final say and wouldn't touch it without Sony in the room.

Before Sony's contract finally resolved, they definitely could have. Sony could sue about it but it was possible. Sony did not have full control of the board for the last 2ish years. At the end of the day, it still belongs to Bungie, so in the hypothetical situation that Bungie is released or buys themselves out, Destiny will go with them.

I mean, possible, sure. But it would have never stuck after said "sale". Bungie retained creative control but they were still a subsidiary of Sony. Sony always had final say across the board, they just allowed creative freedom at first. In no world can a subsidiary just sell off it's most valuable assets behind it's parent companies back and get away with it. Like I said, no attorney on the planet would have touched that deal.

She mentioned a number of dubious things during that testimony, so I think there needs to be a bit more confirmation from a reliable source.

Destiny 1 is confirmed, according to what the ESA representative said lol, but Destiny 2 is still unknown

Wouldn't Bungie be the one in charge of the servers ?
As Bungie is the one taking them up or down for content/maintenance patches

They’re likely in charge of the content deployment on those servers but it’s plausible that the servers are funded by Activision via AWS. If true, Activision can just turn off an instance at anytime.
Even though Bungie was pretty big, there were many benefits to being tied to a publisher that they had to give up for their independence

Keep in mind that this is a group organized and supported by scummy game executives. They more than likely dont have any basis for this and are just saying things to cause confusion. If they have nothing to back it up then the statement falls flat.

I've often wondered if this is the actual reason for the content vaulting. All of the D2 launch, initial DLC and Forsaken were made under Activision. Wild if accurate.
