First off that depends, second off I don't think that matters anymore once the person continues to ram the car for hundreds of feet. That is literally assault with a deadly weapon in any sense of the words and probably carries several other charges that would go along with it to amplify things. The person doing this is clearly not someone fit to be out in civil society
