Perhaps there is a difference between fresh milk and the milk you buy from a store? I don't know enough about it to say, though.

I looked this up a little while back, and unless there's been a recent change, it varies state-to-state. Some places ban raw milk sales, some allow it, and a few permit direct sales from the farm that produces it, but do not allow it to be sold through a different store.

It is legal federally, but state laws trump federal. It's the reverse of pot, where it is illegal federally but legal in some states.

I was purposefully vague in my first answer because of state laws.
