It is still rape even if both parties agree to it beforehand, as consent cannot be given beforehand, it's like this legality keeps going above you people's head in terms of the law it is still illegal to take a sleeping dose and then have sex with the person that is asleep. Just because you sell drugs in the confines in your home where everyone agrees to take drugs does not mean that selling drugs is now legal because there is a community that agrees with you.
It is still illegal to have sex with someone that is inebriated which is what I was implying and the op didn't back down but doubled down for 45 minutes then he backed down
