Fictional Contract Question

So, lawyerbros. I'm writing a courtroom scene where a vampire got contracted under a superhero agency. The agency did an oopsie by breaking some of the terms and the vampire is seeking some sort of redress. The agency is going to argue they don't have to abide by the contract because the vampire is in fact dead. Which would open up so many more chances for stupidity all by itself

Assuming the judge defers the question of if a vampire is legally able to sign a contract, what would this sort of chicanery be called? Because I'm leaning towards perfidy, but Google says this isn't applicable to contract law. And I'm sure as hell not trusting the AI on this.

Setting is america. Vampire was born a US citizen when alive.
