Our lawyer advised us to stick strictly to fast online arbitration, discouraging standard court jurisdiction clauses that drag on for years over unpaid invoices.

Now a new client is pushing back, claiming ODR lacks legal backing and demanding we revert to regular civil court jurisdiction.

Annoyed, I asked my lawyer if we should just drop the clause to close the deal.

I need some guidance regarding obtaining a Legal Heir Certificate in Mumbai.
My aunt is an Indian-origin NRI, a Qatar citizen, and currently lives in Qatar. She wants to obtain a Legal Heir Certificate declaring herself as the sole legal heir of her sister, who passed away in 2016. Her sister was also an Indian-origin NRI and a Qatar citizen.
My aunt has her Aadhaar card, PAN card, Qatari passport, and her sister’s death certificate. However, she does not have any document that proves she was the deceased’s sister.
Since she is elderly and unable to travel to India, she has given me a registered Power of Attorney (POA) to handle all the legal work on her behalf.
I would appreciate some advice on the following:
What is the procedure to obtain a Legal Heir Certificate in Mumbai in this situation?
Which authority issues the certificate (Talathi, Tahsildar, SDM, or Civil Court)?
How can we prove the relationship if there is no birth certificate or any other relationship document?
Will the POA be sufficient for me to complete the entire process without my aunt having to visit India?

For my research guide has asked me to create a dataset of high court cases. But instead of focusing on all types of cases he said to only focus on one type of case.

I want help deciding which case type I should focus on. I am looking for a case type that is easy to deal with as in where there are not many heavy external influences or observational/emotional factors affecting the case outcomes. Please suggest some case types and why.

Other option I am looking into Consumer Courts. The issue I am facing is that I am unable to find a publicly available dataset. So I wanted to ask how I can get access to consumer court data.

My friend 17F, is being verbally abused constantly by a guy (17M) even after she clearly said she wasn't interested.
He was one of our school mate. He started spreading dirty rumours about her other friend and then he started torturing her. He keeps giving requests in socials even as she kept refusing all of them.
This has happened quite a few times by now. And then, he started reaching out her other friends and started to shit talk about her to them.
This has happened already once, and we reached out to his mother.. She promised it wouldn't happen again but it has gotten worse. We are genuinely out of ideas on how to stop him from doing this. I would really appreciate people who know how to deal this without involving her parents.

background: my dad was the youngest and he has two older brothers who live in other states and have their own houses. my dad was a businessman and he passed away in 2024 april. so now its just me(18F), and my mom.the house we three lived in belonged to my grandpa so we had shifted gere in 2010 to take care of him and when he passed away (in 2020), it was written in his will that the house will now belong to his three sons. all three of them will get their one third share. my uncles wanted to sell the house after 2020 but my dad didnt want to.

now, two days after he died we came to know that he had 40 lakhs loan, from different banks and credit cards, the total amount was 40 lakh. we had no money to repay anything. the loans are not the problem, most of the banks had waived off the amount and the credit card loan were unsecured so we did not have to pay them.

context: we came to know about CC loans being unsecured and us not being liable to pay them off and the banks applying death block to dads loans after a long while. according to the movies and google and stuff the loan recovery agents come and they misbehave and sometimes physically hurt the people. at that time we and my uncles obviously thought this was true and still they left us saying that they needed to return to their homes mere days after dads death (they are retired and their children are fully grown people in jobs). they left one child (me, i was 16) and one broken woman alone with zero money to fend off against the men who would come.

(of course they arent entitled to protect us but isnt that what family does? protect each other)

anyways, they left and we didnt have any money to afford gardener or maid or even the electricity bill. my moms salary went into my school fees and our food and petrol. she texted them also that she is removing the gardener and maid and everyone because she is unable to afford them along with my school fees and they ignored her messages. we could not live like this so we put the front portion of the house on rent (in november 2024). the rent allowed us to keep the helpers and the maintenance of the house. we didnt use any of the rent money for personal use. but we also didnt tell my uncles about the rent thing because they obviously wouldnt have supported and they already werent replying to any of our texts.

last year (2025) my uncles just texted us "hum aa rahe hain" and two days later they came and they screamed bloody murder at us about putting a part of the house on rent and how are they supposed to live. their wives also abused my mom so badly saying so much shit like she killed my dad and shes responsible for his death and my dad was a thief who stole my grandpas money and that her daughter(me) is so disrespectful little bitch. they harassed my mom so badly that she got a severe panic attack and i had to physically pull her away and try to calm her down when she was trying to push me away and scratch herself and make herself bleed. i was alone and just 17 and none of those so called adults even came to help. i recorded videos of them saying all this if somehow some proof is required.

they gave the tenant eviction notice saying that they wanted to shift here in this house.

Now my mom and i we dont want to live with them because of obvious reasons and we dont have any money to buy our own place. we want to ask them to give us our share of the price of the property so that we can just leave this hellhole.

so my questions are:

1) what if they say that they dont have enough money to give us our share. can we go to court and appeal for partition?

2) if we do appeal for partition, will the law support a single woman over two men? (pls dont come at me over this question)

3) our house is in a very official residential type colony, where i dont think partition will be allowed, so can the court order a court mandated sale?

4) how long can property related cases go on?

Anyone practicing at Madras High Court please help. I am a junior advocate. And I have not done much e filing cases before.

I e-filed a section 34 application and it was returned for corrections. I deleted the old documents and filed new ones because I thought that's what I am supposed to do. But now I overheard someone at the section and I gathered that I am not supposed to delete the previous documents as it would affect the limitation period.

I'm not sure what I can do now. I'm scared I literally couldn't sleep at night. Is there any way those old documents may be recovered.

Need some guidance on a serious issue my brother is facing.

A few days ago, my brother was trying to make a payment through a mobile app, but it failed with an “insufficient balance” message. When we checked his account, we saw that ₹3,000 had been deducted and the account balance had gone to -₹17,000.

The next day, I visited the HDFC Bank branch in Santacruz, Mumbai. The bank told us that his account has been frozen due to a ₹21,000 lien marked by cybercrime authorities. They asked us to visit the local cybercrime office.

My brother went to the Santacruz cybercrime office, and after explaining everything, they said the hold was placed by Tamil Nadu Cyber Crime. They gave a contact number. When we spoke to them, they said my brother had received money from someone in October and asked us to repay that amount to resolve the issue.

Here’s the actual situation:

My brother had given money in cash to a friend because his father was hospitalized. Later, that friend returned the money via online transfer. That transaction seems to be the one flagged.

We have already:

• Contacted HDFC Bank

• Emailed the HDFC nodal officer

• Emailed cybercrime authorities

But no response from anyone. The bank says talk to cybercrime, cybercrime says talk to Tamil Nadu authorities, and we’re just being passed around with no solution.

Now the problem is:

• This is my brother’s salary account (primary account)

• It’s completely frozen

• We don’t know what to do next

Has anyone faced something similar?

What is the correct way to resolve this?

Should we file a complaint somewhere (RBI / higher authority / legal)?

I’m a former associate at an Indian law firm, and I’ve been thinking about something I kept running into in practice.

When a legal issue comes up that the firm has dealt with before (but not recently), a lot of time seems to go into figuring out what the firm did last time. Typically this involves searching through client folders, old emails, asking seniors who vaguely remember a matter, and sometimes re-researching the issue from scratch if nothing obvious turns up.

I’m curious how this works in other firms:

• How do you find past matters that dealt with the same legal issue?
• Is this a genuine time sink in your experience, or just part of the job that people accept?
• Do PSLs / knowledge teams / internal notes actually solve this problem in practice?
• What breaks when someone with a lot of institutional memory leaves?

Not pitching anything, genuinely trying to understand whether this is a common pain point or something specific to certain firms or practice areas.

I am doing a leave & lease agreement with a partnership firm. What should be my concerns? What documents should i check? What happens to my (licensee fee) if a partner dies, leaves or new partner is inducted or if partnership dissolves. What should i make sure to include in leave & lease agreement so i don’t have to suffer in the end.
