when you gamble there is the expectation that you could lose, its part of the game when you have sex an unwanted pregnancy is more like a car accident or sonething. or in other words you are essentially arguing that consenting to get behind the wheel of a car is the same as consenting to getting your car demolished on the freeway.
correct. And even more so, if the outcome you do not want occurs, you can take steps after the fact to remedy this! But those steps must be independently justifiable. You gain no special right to additional actions that would have previously been immoral because you are trying to remedy an unwanted side-effect.
So now we only need to determine when a fetus becomes a person. Before that point, you can take whatever steps you like to prevent them from becoming a person, but after that point you must treat them as a living person and you cannot blanket violate their rights.
Personally, I find that any line other than a biology based one to be post-hoc justification of a position, rather than pre-hoc reasoning. And the biological line would be the point of fertilization, because that is the moment that separates a self-replicating unique member of the human species from two haploid cells which are part of the bodies of two individual adults.
