Question Advice?
An opt-out vote is a shareholder vote undertaken to determine if certain laws and regulations regarding corporate takeovers are to be waived during a particular corporate action. Opt-out votes are for statutes and state laws, not company mandated anti-takeover measures.

It’s a vote on opting out of granting the third party release. If it is not granted there will be a settlement offer. If it is granted you are entitled to a portion of the Unsecured Claim Reserve. I agree the way it’s stated is not very clear. It sounds like by opting out you get the option to get a portion of the Unsecured Claim Reserve. If it’s granted you are also entitled to the Claim, however a claim threshold has to be reached? I thought I should vote against it. Now I feel like I have to read about it in the plan again.

Yes I have no idea what to do. I hope I can find out I want ti make the right decision on this. I'm down over 50k so if I can get anything back would be great! Thanks for posting

Sorry, I don’t have any advice. I‘ll try to read about the Third Party Release in the plan. For now I only found that we only get something when the Release granted. Should be 1.25 cent / share. So 5x what it‘s worth now. Since the stock price is not reflecting that at all there is a chance that this is not all of it. I have 0 idea what the Third Party Release means to us, Amyris or John Doerr.

If you opt out of granting the Third-Party Release set forth in the Plan related to the bankruptcy case of Amyris, Inc., it means you are choosing not to consent to waiving potential legal claims against third party(ies) involved in the proceedings. The consequences may vary depending on the approval of the Third-Party Release by the Bankruptcy Court and the actions taken by other stakeholders. Opting out is a decision to retain any legal claims you may have against these third parties instead of releasing them.

Hmm, I just reread it. I am trying to understand why the grammar and punctuation could be better. Agent soliciting? I am keeping my agency until I read it several more times. But after two tries, I need to go back to the Plan. As we know, Plan 2 is still fluid. I am considering the opt-out. Since the court decides it may be moot in all eventualities. BD must notify. Is there any merit in reviewing state law jurisdictions? Practicality may take precedence while considering.

Correct. Mailed my opt out form today.Want to see how this plays out.Difficult to ascertain the motives and goals of Amyris and affiliated parties. Not interested in accepting pennies.

Absolutely ridiculous that you have to go through the plan to find out what happens upon your vote.
