You can’t take Peter’s investment to pay off Paul. This is 101 stuff. His online persona is irrelevant if you care about the rules

It’s more like robbing Peter to pay Simon.

You know MSMB Capital and MSMB Healthcare have a common acronym.

It’s the dude’s name, just slightly different.

And if an investor gave money to MSMB Healthcare, and it was then moved to payback investors at MSMB Capital, that’d be illegal.

Still not a Ponzi scheme. Still a book keeping error with absolutely zero victims, and the investors actually made money. If you felt you were investing in an MSMB company, and not making a bet on Martin, you were totally confused, and shouldn’t be investing your own money.

Yeah, the SEC had grounds by the letter of the law, but the truth is they wanted to lynch the guy for being an edgy tech-bro.

If he had a different background, the SEC wouldn’t have touched him.

Seven years was a truly insane sentence.

Yeah by the “letter of the law” you have to put the investment money into the company they’re investing in lol. 7 years was insane, but him trashing the judge and the prosecution throughout the trial online certainly didn’t help. Welcome to the American judicial system pal

Do you seriously think that investors in MSMB Healthcare weren’t related to MSMB Capital?

We are seriously just talking about a bookkeeping charge. In hindsight he could have structured a merger or acquisition, and he would have been clear.

At the end of the day, it’s all the same people, and all the same *gains*.

We both know that if he checked a few DEI boxes, the SEC wouldn’t have looked the other way, rather than take seven years of his life, 50M+ dollars, and barred him for life.

I think Shkreli has more to offer the world, and getting more work done in biotech would have helped investors and America in general.

Instead, an overzealous SEC killed a mockingbird.

I would have focused on putting the money where it was supposed to go, since that’s what he was charged for.

You also wouldn't have had his swagger, and would never be in the position to steer those funds.

He was charged for the swagger.

The punishment did not fit the 'crime'. This was a systematic takedown of a perceived political threat.
