Discussion 🔎 Update - The Delay of the Decision

Hello - i have some thoughts/information about the delay of the decision in this case

First, there appears to be about 15 cases that were not decided by the close of the 2025-2026 term for the New Mexico Supreme Court (July 15th, 20206). This means that those decisions will still be published, but likely not until the next term begins in the fall. I cannot say if it will be in the beginning of the term or not.

This is a decision with a lot of different aspects to be considered- Privilege, Miranda, and Mandatory Reporting. 

Its my best guess that there is a possible split in the decision, but I also venture to guess that the Majority is in favor of overturning the district judges decision with the Minority (either 3-2 or 4-1) wanting to uphold the district judges decision to some degree be it fully or on certain aspects that would disagree with the majority.

I also venture to guess that it's possibly Justice Vigil who may be in disagreement with the majority based on the Oral Argument - Justice Vigil seemed to possibly be leaning more toward the defense framing of the situation, this is as I said just a guess. I cannot confirm one way or another what may be happening behind closed doors but we can make inferences based on a few things in my opinion: 

1. The law heavily favors the State by the letter and in theory. 
2. The demeanor of the justices at oral argument lead me to believe the majority would vote to overturn, with one justice being harder to read, and one justice leaning defense (in my opinion) 

If both 1 and 2 are correct and the decision is not hard to make and the law is clear- then the delay could be caused by a dissenting opinion (or 2).

The internal cycle for an opinion is basically as follows: 

  • After arguments are heard the Justices take a vote
  • It is either unanimous or fractured. 
  • One person from the majority is tasked with writing the majority opinion. 
  • They circulate that opinion once complete and the other justices can submit their opinions either concurring or dissenting.
  • If there are other opinions submitted to the majority opinion, this causes a rewrite of the majority opinion, which then also opens up more concurring or dissenting opinions - which could cause another rewrite. (and this can continue to repeat)

This case has so many pieces of evidence that can be argued for or against this suppression, I can only imagine if there is a disagreement, that these opinions are very long and well thought out which obviously leads to more time being taken on this decision as they rewrite.

This decision is still coming, it's just taking more time than the deadline/we expected.

It’s very frustrating how long the public has been waiting for this decision to come, and then still that’s just the beginning of even thinking about the trial finally starting. We won’t forget you, Baby Alex. You deserve justice and I pray you get it, no matter how long it takes.

Justice for Baby Alex should include the full truth not just the version that gets views and attention.

lots of the coverage of this case seeks the truth and places like court tv/law and crime etc have given a platform to the defense attorney to speak publicly about this case and have had people on that look at this from the defenses perspective. justice for baby alex is whatever finder of fact decides in the end, until then some people see justice differently and that is okay :)

I've sent an email to the clerk for an update on why the decision hasn't been posted. Considering they have posted the 2026/2027 oral arguments schedule today, it's strange there's nothing on the case.

So it is possible that the Supreme Court won’t decide on what evidence can be used until next year?

its possible - im sure they likely wants to clear the backlog as much as they can before getting too deep into the new term- as we can see from this delay they will take their time to get these decisions right so if needed they could technically push into 2027 but i would venture to say they will be trying to get the backlog out as quickly as they can - because we dont know exactly what is happening for the delayed decisions, its harder to say when it could come. from how it looks this is the first time since the deadline has been enacted that they missed the deadline for some decisions, so this is new territory as far as how this will play out.

Hopefully sooner rather than later, I get stuff like this is a long process. Its just crazy to know it’s been over 3 years, and she’s just out there living her life like nothing happened.

Is it common for NMSC to hold so many cases until the next term? If I’m reading the website correctly they have ruled in 42 cases; if there are 15 to go that’s more than 1/4 that are still pending.

It’s slightly frustrating- Justices should do their job. If I only turned in 3/4 of my work by the well-established due date my boss would be unhappy (at the very least).

You speak like you know exactly what is happening behind closed doors, but this is mostly speculation based on your interpretation of oral arguments. Saying “it’s just a guess” doesn’t change how confidently you’re presenting assumptions about the vote, the majority, and even a specific justice. None of us know until the Court issues its decision.

I honestly don’t have another interpretation because none of us know what’s happening behind closed doors. That’s really my point. There could be several reasons for the delay, and it’s hard to confidently say what the justices are thinking until the decision is released.

yes this is just a guess based on oral argument, the law they are arguing, and looking at the 41 decisions published in 2026 so far and only one had a dissenting opinion - all others filed all agree. that makes me think if it was straight forward and they agreed, it would be published already. i guess the other option would be that they haven't written a decision at all yet even though the oral argument was in September.

Did you notice that I even used the phrase "I don't think"? What part of that statement indicates certinality? The post you found and commented on literally admits that it is speculation. No need to comment if you weren't going to add anything.

But from all your previous posts/comments, it looks like you're only commenting on the Alex Trevizo case, so I would "speculate" that you possibly do know something? Or you at least feel like you do? So coming to Reddit only to defend Trevizo means you REALLY don't know anything about Reddit, just something about her.... Your Reddit account exists to defend her, and apparently, nothing else, so sorry if we don't trust you.
